Katherine Jackson replaces lawyers in estate battle

LOS ANGELES, California (CNN) -- Michael Jackson's mother fired the lawyers helping her fight for control of her son's estate, but her new lawyer missed a key hearing where the judge gave more power to the men she is opposing.
Katherine Jackson, with Michael in 2005, is challenging the appointment of Michael's estate trustees.

Katherine Jackson replaced lawyers Burt Levitch and Londell McMillan with Adam Streisand, a lawyer known for his expertise in Los Angeles probate cases.

"The family came to a decision before they called me," Streisand said. "They felt they needed a different perspective and fresh look at how this case was being approached."

But Streisand arrived at court Thursday minutes after Los Angeles Superior Court Judge Mitchell Beckloff ended a hearing in which he granted a request from estate special administrators John Branca and John McClain for more authority to make deals on behalf of Jackson's estate.

"I want this estate to move forward and I want these creditors to be dealt with," Beckloff said. "And while we are proceeding in this posture, I want Mrs. Jackson to have information about what is going on and I don't want to be in court all the time."

The process of probate of Jackson's will, which named Branca and McClain as executors, has been slowed since soon after the pop star's June 25 death by numerous legal challenges filed by Katherine Jackson's lawyers, led by Levitch.

Howard Weitzman, lead lawyer for the estate's administrators, expressed optimism that the two sides would be able to work better toward a settlement with Streisand in charge.

The estate's administrators were able to make a series of deals expected to bring in at least $100 million to the estate this year, mostly through a documentary movie that premieres next week.

Katherine Jackson's legal team has asked that a member of the Jackson family "have a seat at the table" as a third executor.

They've also raised questions in sealed court papers about possible conflicts of interest that might prevent Branca and McClain from controlling the estate.

Streisand said the Jackson family was frustrated with the inability "to get this case going."

He indicated Katherine Jackson still planned to challenge Branca and McClain's control of her son's wealth.

Under the 2002 will, Michael Jackson's three children and his mother are the chief beneficiaries of his estate, while unnamed charities will share in 20 percent of the wealth.

Streisand said when he met with Katherine Jackson and the children to discuss the case, they were united.

He said Jackson patriarch Joe Jackson was not present at the meeting and he's never talked with him.

Joe Jackson appeared frustrated earlier this month when he attended his first hearing in the probate process, suggesting the lawyers should be more aggressive in court.

Streisand said the three Jackson children are doing "absolutely wonderful."

  • Michael Jackson’s ‘Thriller’ collaborators, former manager seek payments for unpaid debts

    Jackson collaborators seek debt payments

LOS ANGELES — Michael Jackson’s collaborators on “Thriller” say they are due more than $2.3 million from the singer’s estate.

George Folsey Jr., the producer of the iconic 14-minute “Thriller” video, filed a claim Thursday for more than $1 million he says he’s owed.

An attorney for the video’s director, John Landis, filed creditors claims against the singer’s estate — also on Thursday — saying they are likely due more than $1.3 million. Landis and his company sued Jackson before his death, claiming the singer hadn’t paid Landis his share of profits in recent years.

Landis also sued to stop Jackson from exploiting new “Thriller” projects, such as a Broadway show. Those cases are still pending.

Jackson’s former manager, Leonard Rowe, also claimed Thursday the singer owed him more than $300,000.

  • looool, der rowe will 300.000?

  • MJ Accused of Stiffing Lawyers Out of $1.5 Mil

A team of Michael Jackson's former lawyers claim the singer owes them more than $1.5 million dollars stemming from an agreement he signed way back in 2007.
The firm -- Mundell, Odlum & Haws -- filed a creditor's claim against Jackson's estate today, explaining how they were never paid back for a $1,144,808.95 promisary note Jackson signed back in 2007. It's unclear what the note was for.
The firm also claims they were never paid for hundreds of thousands of dollars of legal work they performed for Jackson from December 2007 through June 24, 2009 -- the day before Jackson died.
Grand total -- $1,571,768.62 plus interest.
Add this one to the stack....

Na, klar und jetzt kommen noch ein paar Anwalte die Geld haben wollen - schlappe $1,57Mio........ was die wohl für Stundensätze veranschlagt haben :spinnen

  • MJ's Last Recording - Subject of Creditor's Claim
Posted Nov 2nd 2009 1:30PM by TMZ Staff
We've now learned the basis for the latest creditor's claim against Michael Jackson's estate -- and it could be a goldmine.

As we first reported, Audio 4 Video Digital (A4V Digital, Inc.), filed a creditor's claim for $736,502.59. Sources connected with A4V tell TMZ that Jackson had been recording songs shortly before he died and A4V was working on the music at the time of his death.

An A4V source says the company is a co-owner -- along with the estate -- of the copyright for the sound recordings. This could represent the last work of Michael Jackson -- so good, bad or ugly, it could be the royal jackpot.

We're also told A4V was working with Jackson for years before his death and has a stockpile of recordings that have never been released.

  • Jackson Creditor's Claim Over Neverland

  • Michael Jackson's father moves to oust will executors

Los Angeles, California (CNN) -- The battle for control of Michael Jackson's estate took another turn Monday as the pop singer's father filed a challenge of the men named as executors in Jackson's 2002 will.

Joe Jackson, who was not named as a beneficiary of the will, contends John Branca and John McClain must be disqualified as executors because they hid from the court a mistake regarding Jackson's signature, Brian Oxman, Joe Jackson's attorney, told CNN.

The signature section of the will said it was signed on July 7, 2002, in Los Angeles, although there is proof Michael Jackson was in New York on that date, Oxman said.

"The executors have an obligation to tell the court the truth, the whole truth and nothing but the truth," Oxman said. "But for four months they've been silent as to where this will was signed. They are concealing this from the court and you cannot do that."

Howard Weitzman, one of the attorneys for Branca and McClain, responded by saying Joe Jackson's claims "are so outrageous that they don't deserve any response."

"John Branca and John McClain, who were designated by Michael Jackson in his will as executors of his estate, will continue carrying out Michael's wishes for the benefit of his mother, his children and charities," Weitzman said in a statement.

Judge Mitchell Beckloff, who is overseeing the probate of Jackson's estate, will hold a hearing in Los Angeles Superior Court Tuesday morning. It is expected he will choose a date in that hearing to consider the arguments on these and other matters related to the estate, Oxman said.

Joe Jackson also filed a request last week asking Judge Beckloff to order the estate to pay him a monthly allowance. While he is married to Jackson's mother -- Katherine Jackson -- he lives separately in Las Vegas and does not share in the monthly allowance from the estate.

Oxman filed a petition Monday afternoon listing 11 grounds for Branca and McClain's dismissal as executors.

In addition to the issue of where the will was signed, Oxman said Branca had several conflicts of interest concerning his involvement with overseeing the partnership between Jackson and Sony to own music catalogues.

The petition also contends that Branca was fired as Jackson's lawyer in 2003, but failed to resign as an executor to the estate as he was ordered.

Michael Jackson died June 25, but the probate of his will has been slowed by a series of court squabbles.

Katherine Jackson is pursuing her own challenge of Branca and McClain. Her lawyers have indicated they would present evidence that the men have possible conflicts of interest that would disqualify them.

Oxman said his grounds for challenging them is separate and different from Katherine Jackson's challenge.

Katherine Jackson's legal team has asked that a member of the Jackson family "have a seat at the table" -- as a third executor.

Under the 2002 will, Michael Jackson's three children and his mother are the chief beneficiaries of his estate, while unnamed charities will share in 20 percent of the wealth.

  • Keinen Cent für Papa Joe
    Michael Jackson: Das Erbe

    11.11.2009, 10:12

Posted Nov 13th 2009 1:39PM by TMZ Staff
Michael Jackson's former manager just filed a huge creditor's claim against the estate ... and it's mostly over the sale of Neverland Ranch in 2008.

In the documents, filed yesterday in L.A. County Superior Court, Dr. Tohme² says he was promised a certain fee from Michael if he could locate a company to save Neverland Ranch from foreclosure last year.

Dr. Tohme² claims he's the one who brought Colony Capital LLC to the table -- the company T² says forked over $23 million to save Neverland. Dr. Tohme² wants his cut of the deal -- which he claims is approximately $2.3 million.

In July of 2008, Dr. Tohme² also says Michael promised him 15% of the singer's "gross compensation within the entertainment industry" -- but T² has no clue how much he's owed for this one.

The doc wants in excess of $2.3 million.
