  • HBO will air Michael Jackson documentary ‘Leaving Neverland’ despite lawsuit

    HBO is standing by its decision to air a four-hour “documentary” detailing the stories of two men who accuse Michael Jackson of molestation in the face of a suit filed by the Estate of Michael Jackson that claims airing the film would be a breach of contract.


    “Despite the desperate lengths taken to undermine the film, our plans remain unchanged,” the network said in a statement to CNN.


    “HBO will move forward with the airing of ‘Leaving Neverland,’ the two-part documentary, on March 3rd and 4th. This will allow everyone the opportunity to assess the film and the claims in it for themselves.”


    This is the response from HBO to the Michael Jackson Estate’s lawsuit and they’ve gone again to the media with their answers and not directly to the Estate!

    The burgeoning battle between the estate of Michael Jackson and HBO over the controversial Leaving Neverland sex abuse documentary is moving into a full-scale legal war that could cost the premium cabler up to $100 million.



    “The Jackson Estate will seek all damages proximately caused by HBO’s reprehensible disparagement of Michael Jackson, which could exceed $100 million should HBO succeed in the damage it is intending to cause to the legacy of Michael Jackson,” said an injunction and arbitration seeking breach of contract complaint filed today by lawyers from Kinsella Weitzman Iser Kump & Aldisert LL and Freedman + Tailtelman LLP in L.A.     “Petitioners further pray that the arbitrator award punitive damages in the maximum amount permissible if and when Petitioners show their entitlement to such damages,” the 53-page filing adds.



    Having premiered under a heavy police presence at the Sundance Film Festival last month, the Dan Reed directed Leaving Neverland is set to debut on HBO on March 3 and 4.



    “HBO breached its agreement not to disparage Michael Jackson by producing and selling to the public a one-sided marathon of unvetted propaganda to shamelessly exploit an innocent man no longer here to defend himself,” Jackson estate attorney Howard Weitzman told Deadline Thursday. “



    “HBO could have and should have ensured that Leaving Neverland was properly sourced, fact checked and a fair and balanced representation,” he added in language similar to a letter sent to HBO CEO Richard Plepler over a week ago. “Instead they chose to fund and produce a film where they knew the two subjects had for many years testified under oath and told family, friends and law enforcement that Mr. Jackson did nothing inappropriate to either of them.”



    HBO did not respond to request for comment on today’s legal move.



    However, HBO execs asserted earlier this month that they stood by the film and nothing was going to stop it from airing in early March. “The one thing I would say about this documentary is I would ask everybody to watch it and make their judgments after seeing it,” the premium cabler’s programming chief Casey Bloys asserted on February 21.



    “Nearly four years after Michael died they suddenly changed their recollections, sued the Estate of Michael Jackson for hundreds of millions of dollars and had all of their lawsuits dismissed,” Weitzman continued in his statement attacking Wade Robson and James Safechuck, who claim in the film that they were sexually abused by the ‘Thriller’ superstar when they were children. “Yet they are still seeking money, having appealed. HBO and the director were well aware of their financial motives and that ample opposing facts are available from numerous sources, but made the unconscionable decision to bury any evidence casting doubt on their chosen narrative. Had they made an objective film it would have allowed viewers to make up their own minds about these allegations, instead of having a television network dictate to them that they must accept these false claims about Michael Jackson.”



    Since it was announced in early January that Leaving Neverland would open at Sundance, Jackson fans around the world have taken to social media and elsewhere to condemn the documentary.



    With the constant whiff of legal action in the air from the very beginning, representatives for the estate of Jackson — who died in 2009, four years after being acquitted of seven counts of child molestation and two counts of giving a drug to a 13-year-old boy — previously tainted Neverland as “just another rehash of dated and discredited allegations.”

    If you recall, the Estate of Michael Jackson and the company “King of Pop-corn” company were in legal battle over the name “King of Pop”

    The Estate sued Gourmet Gift Baskets in 2016, alleging that the company’s use of KingOfPop.com for a website selling popcorn infringed on the late musician’s famous moniker.


    According to court records, the two parties settled in 2017. But the Michael Jackson’s estate just got control of the domain name in recent days.

    This suggests that the confidential settlement had about a two year transition period to allow Gourmet Gift Baskets to transition its use of the domain. The domain resolved to its former website until about the middle of 2018, at which point it began forwarding to gourmetgiftbaskets.com/popcorn.

    Changing a site’s domain name is hard; changing an entire brand is even more challenging.

Mit der Behauptung, dass Michael Jacksons Spitzname missbraucht werden würde, verklagte die Nachlassverwaltung Gourmet Gift Baskets im Jahr 2016. Obwohl beide Parteien bereits 2017 zu einer Einigung kamen, erlangte das Estate erst kürzlich die volle Kontrolle über den Namen.     Ahead of its highly anticipated Broadway premiere, the new Michael Jackson-scored musical, previously titled Don’t Stop ‘Til You Get Enough, has been re-titled MJ. The previously announced musical will make its world premiere on the Great White Way in the summer of 2020, with dates and a theater to be announced soon.


    “We can confirm that the Michael Jackson musical has a new title,” production spokesperson Rick Miramontez said. “As the show has evolved through its development process, the production felt that MJ was a better and stronger choice than relying on the title of any one individual song.”


    Unfortunately Lynn Nottage is still part of the project despite her saying publicly that a recent “movie” was “very believable”!

    MJ, the new musical inspired by the life of Michael Jackson, has been rumored to be Broadway-bound for some time.

    Today, producers have made it official. The musical, drawing from the hits performed by the pop superstar, will begin previews on July 6, 2020, toward an opening night of August 13. MJ will have its run at Broadway’s Neil Simon Theatre.

    Tickets for MJ The Musical will go on sale on January 15, 2020, at 10 a.m.

    As we are sure you have recently read, tickets for the new Broadway play, “MJ The Musical”, go on sale January 15 with previews starting at the Neil Simon Theatre on July 6, 2020 and the show will premiere on August 13, 2020.


    In the meantime, we wanted to say how excited we are about the show. We were excited when we worked with Cirque du Soleil and Jamie King in creating “Michael Jackson THE IMMORTAL World Tour” which went on to become one of the most popular and highest grossing touring shows of all time. And we were equally excited about working again with Cirque de Soleil and Jamie King in creating the “Michael Jackson ONE” show in Las Vegas which just enjoyed its 3,000th performance and remains one of the top selling shows in Las Vegas.


    We also were very pleased about the work we did with Spike Lee in creating the “Bad 25” documentary and the documentary “Michael Jackson’s Journey From Motown to Off the Wall.”


    We are confident that this new Broadway show will be every bit as good as any show we have had a hand in creating.


    Some of you have expressed concern about Lynn Nottage. Let us assure you that Lynn Nottage is a huge Michael Jackson fan. We are always careful about selecting the creative talent who will work on a Michael Jackson project. She was ambushed by the UK tabloid reporter and statements made in casual conversation were taken out of context and have been misconstrued. No show we ever create about Michael will be anything other than truthful and positive, and of course we would never validate the lies and slander that have been perpetrated by Reed, Robson, Safechuck and HBO in what the fans have called a “bullcrapumentary.”


    The creative team on this Broadway show is outstanding. Lynn Nottage is the only living playwright who has won two Pulitzer Prizes. Christopher Wheeldon, also a huge Michael Jackson fan, is an acclaimed director and choreographer who won the Tony Award for his work on “An American in Paris” on Broadway.


    Having seen rehearsals and read the book we can assure you fans will be very excited. Of course, no one can replace Michael. No one can do what Michael did. There was a reason that Berry Gordy confirmed that Michael is the greatest entertainer who ever lived. However, just as in any movie where a famous historical figure is portrayed, once we enter the playhouse, we have to suspend our disbelief and look forward to seeing a great show paying homage to Michael’s legacy.


    You all know that the media has tried very hard to negate Michael’s influence in the world. To use their term, they tried to cancel Michael. The Michael Jackson fans and the Michael Jackson Estate will not allow that to happen. The love of Michael is too strong, it will always be with us. While some media outlets might be hesitant to telecast new Michael Jackson programs in the short term, that will turn around in the long term since everyone wants to see and enjoy Michael and his work. This Broadway show will go a long way toward reminding the world who the King of Pop is. Let’s celebrate it, let’s embrace it and let’s remind everybody that Michael is the greatest of all time.

  • HBO is appealing a judge’s decision last month that sided with the Michael Jackson estate in its battle against the documentary “Leaving Neverland.”

    The four-hour documentary details the allegations of Wade Robson and James Safechuck, who allege that Jackson sexually abused them when they were young boys. The film won the Emmy for best documentary or nonfiction special in September.

    The Jackson estate has waged a high-stakes PR and legal battle against the film, suing HBO for $100 million and claiming that the subjects had a financial motive to lie. The estate sought to compel HBO into arbitration, claiming that the cable network was violating a 1992 contract for a Michael Jackson concert film which contained a non-disparagement provision.

    HBO has argued that the documentary was protected by the First Amendment, and that the Jackson estate was seeking to chill public debate on child sexual abuse. HBO sought to dismiss the case under California’s anti-SLAPP statute, which prohibits frivolous suits that threaten free speech on matters of public concern.

    In his ruling last month, Wu found that the anti-SLAPP statute does not apply to arbitration requests. He denied the motion to strike the suit, and ordered the case to arbitration. Wu acknowledged that his ruling would likely be appealed.

    HBO filed a notice on Monday that it would appeal the ruling to the 9th Circuit Court of Appeal.

    John Branca, the attorney who is co-executor of the Jackson estate, called the move a “cover-up.”

    “If HBO truly believed that their desperate attempt to grab ratings was true, accurate, and fair, they would not be so strenuously avoiding a public reckoning of this junk programming which has become known as the Lies of Leaving Neverland,” Branca said in a statement. “The agenda is set at the top. Stockholders are questioning HBO’s leadership.”


    Howard Weitzman, an attorney for the estate, said the appeal was a frivolous attempt to avoid the inevitable.

    “Soon there will be a hearing, as the Court ordered, and damages will be awarded for HBO’s intentional and unlawful conduct,” he said. “The real questions are what is HBO afraid of and how much will they end up paying the Estate of Michael Jackson.”

    The dance-off over Leaving Neverland is far far from over. Less than a month after HBO lost an attempt to get the multimillion-dollar lawsuit from the estate of Michael Jackson against the Emmy-winning documentary tossed out, and saw a federal judge shift the whole matter towards arbitration, the AT&T-owned premium cabler kicked back Monday. In a short filing, HBO’s lawyers from Gibson, Dunn & Crutcher LLP and O’Melveny & Myers LLP notified the court that they intend to take the matter upstairs, so to speak.

    It’s pretty clearly the Jackson estate and their attorneys thought that was bad – really bad.

    “This bogus appeal is nothing more than HBO’s latest desperate attempt to cover up the truth about its shoddy journalism,” Freedman & Taitelman, LLP’s Bryan Freedman said a statement this afternoon.

    “For seven months HBO has tried and failed to avoid a public arbitration,” the lawyer added of the turns of the $100 million lawsuit the estate launched in late February. “This appeal, which is its latest Hail Mary attempt, is even more pathetic than all of its other attempts to avoid public scrutiny. If HBO truly wanted to avoid a judgment, it should have thought about that before it aided and abetted a one-sided documentary without any journalistic integrity and in which the subjects have a huge motivation to lie – namely the millions of dollars for which they are suing the Estate. Our client will never stop until justice is served.”


    Having fist premiered at the Sundance Film Festival under threats and police protection, and then debuting on HBO to big viewership on March 3, the Dan Reed-directed Leaving Neverland spotlighted specific claims by Wade Robson and James Safechuck that they were sexually abused by Jackson back when they were children.

    “HBO’s frivolous appeal to stall the court’s Order to arbitrate this dispute is yet another attempt to avoid the inevitable,” fellow Jackson estate lawyer Howard Weitzman said Monday. “Soon there will be a hearing, as the Court ordered, and damages will be awarded for HBO’s intentional and unlawful conduct,” the Kinsella Weitzman Iser Kump & Aldisert partner added with a verbal grenade. “The real questions are what is HBO afraid of and how much will they end up paying the Estate of Michael Jackson.”

    Called out as another set of smears upon the deceased pop star, the estate’s attorneys hoped to bludgeon the film, the filmmaker and the outlet by dredging up a portion of a 1992 deal between Jackson and HBO over a concert special as proof of the legal miscarriage by the premium cabler. That citation of the almost three-decade old agreement didn’t get much movement for the estate, and the case moved out of L.A. Superior Court to federal court in early March for jurisdictional reasons.

    The August 15 move to dismiss from HBO’s legal team came following a ruling in late May by U.S. District Court judge Wu to stop the Jackson estate’s desire to have the matter shut away behind closed doors and be decided by the American Arbitration Association. The estate also lost out in its aim to have the lawsuit sent back to state court. Last month, the often-unpredictable Wu went the other way and bundled together a series of rulings to put the matter in open arbitration.

    From that point on, the HBO appeal was basically a done deal waiting to happen.

    Coming as WarnerMedia gets ready to put its HBO Max streaming service on the launch pad next year and some ornery shareholders kick up dust about AT&T’s purchase of DirecTV and a few other corporate decisions, the Jackson estate is now out for legal blood.

    “This is a cover-up,” asserts estate co-executor John Blanca of the appeal move by HBO. “If HBO truly believed that their desperate attempt to grab ratings was true, accurate, and fair, they would not be so strenuously avoiding a public reckoning of this junk programming which has become known as the Lies of Leaving Neverland,” he kitchen sinks and then some. “The agenda is set at the top. Stockholders are questioning HBO’s leadership.”

    Before his death from a prescription drug overdose in 2009, Jackson settled a previous child abuse claim in 1993 and was acquitted of other such charges in 2005.

    HBO did not return request for comment on its appeal filing today.

    These are the estate's responses to the court's specific questions following AB 218 passing:



    A. Applicability.



    The estate concedes AB would allow late filing of claims if appeals aren't concluded by Jan. 1. This would eliminate partial—but not all—focus of appeal; with regard to 340.1(b)(2).



    Estate reiterates that it would challenge applicability later as law evolves.



    B. Other Issues (1)



    Estate argues appellate court must affirm case dismissal if it is based on any other grounds stated in demurrer. This includes at least 4/6 other causes JS can't prove:



    - Negligent Supervision


    - Negligent Hiring


    - Failure to Warn

    Emphasis is placed on fact that appellate court can uphold trial ruling based on any other noted findings in the demurrer, whether or not the trial court intended the other (non time-related) findings to support the demurrer or acted upon them specifically.

    Estate concedes that unlike JS, WR's demurrer is based only on statute of limitations (likely reversed via AB 218).



    But since they both argue same causes of action, court should wait to rule on WR's until after JS' is decided, based on arguments above.

    Wade's case was litigated 4.5 years w/ less than 5 mo. left to try when summary judgment came. If remanded, estate needs time for new discovery relating to Wade's PR tour & LN etc. Appellate court should decide time options if remanded.

    Tony Award nominee Ephraim Sykes will moonwalk on Broadway, playing Michael Jackson in “MJ The Musical.”


    It begins previews on July 6, 2020, at the Neil Simon Theatre with an official opening set for Aug. 13.


    Sykes is currently appearing in another pop music celebration, “Ain’t Too Proud — The Life and Times of The Temptations.” He earned a Tony nomination for his turn in the show as David Ruffin and a Grammy nomination for the cast recording of the show. Sykes also appeared on NBC’s “Hairspray Live!.” On Broadway, his credits include “Hamilton,” “Newsies,” and “Memphis.”


    “MJ The Musical” will feature a book by two-time Pulitzer Prize winner Lynn Nottage (Who still hasn’t publicly clarified her view on Michael Jackson’s innocence since she spoke out in different interviews saying she believed the accusers). Tony winner Christopher Wheeldon (“An American in Paris”) will direct and choreograph the show. The show is produced by Lia Vollack and the Michael Jackson Estate.

    Michael Jackson‘s business partners lose their bid to grab a share of his assets after judge rejects claim the star promised them a stake in his company

    A Los Angeles judge has rejected a claim by two of Michael Jackson‘s former business partners that the star had granted them shares in his company during a meeting in a Tokyo hotel room.

    The singer‘s former publicist Raymone Bain and Quadree el-Amin, who managed the band Boyz II Men, claimed they had a verbal agreement with the Thriller star to hand over a small share in his company.

    Both claimants said the star agreed to hand over 1.6 per cent each as well as the same share for a third person. A fourth member of the group was allegedly promised 10 per cent.

    However, a judge ruled they had missed the filing deadline for the action and questioned the accuracy of their claim.

    According to , the pair claimed to have met with Jackson on June 1, 2006 and the star made the offer to give them a share in his company because they had stood by him during his child molestation trial.

    However, the judge ruled they could have lodged their claim while Jackson, who died in July 2009, was still alive.

    Howard Weizman, who represents Jackson‘s estate, welcomed the court‘s decision.

    He told TMZ: ‘This was a frivolous and outrageous case and these claimants got what they deserved – which was nothing.‘

    BMI (Broadcast Music Inc.) and The Estate of Michael Jackson announced today that they have inked a renewal agreement for BMI to continue to represent the performing rights in Michael Jackson's songwriting catalog. This new deal continues an uninterrupted 41-year long relationship between the King of Pop and the performance rights organization which began in 1979 when Michael Jackson first signed with BMI. The Estate and BMI last renewed the deal in 2014.


    "Michael first signed with BMI in the nascent stage of his solo career and BMI has never wavered in its commitment to his extraordinary talent.
