  • Michael Jackson estate gives to Broadway / Vegas needy amid outbreak

    LOS ANGELES (AP) — The Michael Jackson estate is donating $300,000 to help entertainment industry workers on Broadway, the music business and in Las Vegas who have been hurt by the coronavirus pandemic.

    The estate announced Wednesday that it will give $100,000 apiece to Broadway Cares, the food bank Three Square in Nevada and MusiCares, because all three areas have been good to the estate and to Jackson.

    "This virus, this pandemic affects all of us obviously, so we wanted to start in our own communities," John Branca, the estate's co-executor, told The Associated Press. "This is personal for us."

    A Jackson-themed Broadway show, "MJ The Musical" is scheduled to start previews in July, though like the rest of Broadway it is currently on hold amid the coronavirus shutdown. No announcements have been made on postponing the show, and the estate and producers are taking a wait-and-see approach, Branca said.

    "Michael Jackson ONE," the long-running Jackson-based Cirque du Soleil show at Mandalay Bay in Las Vegas, where Jackson lived late in his life, is also on hold indefinitely.

    "Las Vegas has been very good to Michael," Branca said.
    The estate's donation there will provide 300,000 meals to the needy, and help to maintain the supplies of the food bank Three Square, the estate said.

    In New York, the estate says it is donating to Broadway Cares/Equity Fights AIDS' COVID-19 Emergency Assistance Fund, and will give the rest to MusiCares, the charitable branch of the Recording Academy that helps those in the music industry who are economically struggling.

    The estate says the donations are inspired by the constant charitable work of Jackson himself.

    "Michael was extremely generous both of his time and his money in his life, and it's in his music too," Branca said. "We look to Michael for leadership and inspiration. We're doing what Michael would have been doing."

    For most people, the new coronavirus causes mild or moderate symptoms, such as fever and cough that clear up in two to three weeks. For some, especially older adults and people with existing health problems, it can cause more severe illness, including pneumonia and death.

    Other performers and support staff in music and on Broadway are sick or have been left without work and are facing an uncertain future. And in Las Vegas, which has been so welcoming to Michael Jackson, the entire city has been shut down leaving thousands of workers and their families devastated and without an income.



    “Michael’s spirit of generosity and helping others during his lifetime is legendary. These donations are inspired by him,” they concluded.



    In New York, the Estate is answering the challenge made by more than 20 Broadway producers who are matching up to $1 million in donations, doubling the impact of contributions to Broadway Cares/Equity Fights AIDS’ COVID-19 Emergency Assistance Fund. Jackson loved attending Broadway performances and the Estate and its partner, Lia Vollack Productions, continue to look forward to welcoming audiences to MJ the Musical later this year.



    “With every passing day that theaters remain dark, entertainment and performing arts professionals face unprecedented and immediate challenges,” said Tom Viola, executive director Broadway Cares/Equity Fights AIDS.



    “This incredibly generous donation from the Michael Jackson Estate will help ensure those onstage, backstage and behind the scenes get lifesaving health care, emergency financial assistance and counseling during and after this crisis.”



    In Las Vegas, the Estate’s donation will provide 300,000 meals to the needy, and help to maintain Three Square Food Bank’s supplies, the largest foodbank in Southern Nevada. Since opening in February 2013, Michael Jackson ONE, produced by Cirque du Soleil and the Estate of Michael Jackson, has been one of the most popular shows in Vegas.


    “Before the pandemic, 1 in 8 Southern Nevadans lived in a food-insecure household and that number will increase exponentially with the displacement of thousands of workers in our community.

  • Quincy Jones Loses $6.9 Million on Michael Jackson Verdict Appeal

    An appellate court ruled on Tuesday that the Michael Jackson estate does not have to pay $6.9 million in royalties and fees to Quincy Jones.

    The three-judge panel of the 2nd Appellate District overturned the bulk of a 2017 jury verdict, finding that the trial judge had allowed the jury to misinterpret Jones’ contract.

    Jones’ attorneys had argued that the producer was entitled to some $30 million in royalties and other income derived from the “This Is It” concert film, two Cirque du Soleil shows and other revenue streams that followed Jackson’s death in 2009. After a two-week trial, the jurors awarded Jones $9.4 million.

    But on Tuesday, the appeals court took most of it back, saying that Judge Michael L. Stern had erred by not interpreting the contract himself, and instead leaving it up to the jurors.

    After Jackson’s death, his estate negotiated an increased share of profits through a joint venture with Sony, going from 50% to two-thirds. Jones’ attorneys argued at trial that he was entitled under his producer contract to a proportional increase in royalties. The jury agreed, granting Jones $5.3 million in joint venture profits.

    But the appeals court ruled that Jones’ producer contracts did not entitle him to such an increase.

    “The language of section 4(a) cannot be tortured to mean that Jones’s maximum royalty rate increased proportionally if Jackson’s maximum royalty rate increased,” wrote Justice Judith Ashmann-Gerst, on behalf of a unanimous panel.

    The court also vacated an award of $1.6 million in remix fees, which Jones claimed he was owed. Jones’ contract gave him first right of refusal on remixes of his Jackson albums, which he was not afforded. But the panel held he was not entitled to be paid fees for remixing work that he did not perform.

    “The only compensation Jones was entitled to receive was royalties from record sales on remixes, and the evidence indicates he received them,” Ashmann-Gerst wrote. “If he wanted remixing fees, he had to negotiate them in separate agreements.”

    The court left in place the remaining $2.6 million awarded to Jones, which consisted of unpaid license fees from “This Is It,” plus other fees and interest.

    Jones had also appealed two of Stern’s rulings that went against him. His attorneys argued he should have been allowed to claim elder abuse, and should have been awarded interest on a greater portion of the damages award. Those appeals were both denied.

    Howard Weitzman, who represented the Jackson estate, issued a statement claiming vindication.



    “Quincy Jones was the last person we thought would try to take advantage of Michael Jackson by filing a lawsuit three years after he died asking for tens of millions of dollars he wasn’t entitled to,” Weitzman said. “We knew the verdict was wrong when we heard it, and the court of appeal has completely vindicated us. From the beginning this was an attempt to take advantage of Michael knowing he wasn’t here to defend himself.”



    John Branca, co-executor of the estate, also issued a comment: “So many people have tried to take advantage of Michael and mischaracterize him since his death. It’s gratifying that in this case the court in an overwhelmingly favorable and just decision, recognizes that Michael Jackson was both an enormous talent and an extremely fair business executive.”



    Kirk Dillman, an attorney representing Jones, also put out a statement in which he chose to look on the bright side: “While we disagree with portions of the Court’s decision and are evaluating our options going forward, we are pleased that the Court affirmed the jury’s determination that MJJP failed to pay Quincy Jones more than $2.5M that it owed him.”

    Michael Jackson Estate's Battle With Ex-Manager Ends As Court Enforces $3M Settlement

    Tohme Tohme and Michael Jackson's estate reached a settlement mid-trial in 2019, and a California judge has found their oral agreement is binding and it doesn't matter that they haven't signed a written version.



    Michael Jackson's ex-manager Tohme Tohme's longstanding legal war with the King of Pop's estate has ended as a California judge ruled that he's owed the $3 million he was promised in a 2019 settlement even though the deal was never finalized in writing.



    Tohme first sued the estate in 2012. He claimed he's owed a 15 percent commission on compensation Jackson received during his last year of his life, plus a cut of the hugely successful concert film This Is It, which was released a few months after the singer's death, and a finder's fee for securing a loan that prevented foreclosure on Neverland Ranch. It seemed the feud was ending a year ago when the parties reached a settlement mid-trial in May 2019 — but they struggled to agree upon a written version and Tohme sued again.



    According to a court filing, which was improperly redacted, Tohme will received $3 million as part of the settlement. The estate hasn't paid, but it argued that's because they never executed their agreement in writing and the deal required a mutual release. Through that release both the estate and Tohme would "irrevocably, unconditionally, release, acquit and forever discharge" any and all claims against each other. The estate in its response filing argued such an agreement was necessary because the "intent of the settlement was to finally put to rest all of Tohme's claims, so that the Estate is not burdened by future litigation of old claims."



    Tohme in November sued John Branca and John McClain, as representatives of the estate, for breach of contract in an attempt to get the court to force them to pay up. He claims the draft of the agreement the estate sent him included terms he hadn't agreed to and it was never signed, but that doesn't matter because they made an oral agreement.



    He moved for summary judgment and the estate pushed back arguing that the parties had mutually understood the deal wouldn't be final until the ink was dry and it was Tohme who breached their agreement by refusing to sign the agreed upon release.



    L.A. County Superior Court judge Mark A. Young on Tuesday granted Tohme's motion. He found that the parties had formed an oral agreement and the evidence presented by Tohme suggests the estate, in refusing to pay, didn't keep up its end of the deal.



    "Here, the parties orally agreed to all of the terms and conditions of a settlement agreement," finds Young, noting specifically that their oral agreement included a mutual general release of claims. "Defendant fails to produce any evidence that parties intended for there to be a binding contract after a writing was produced, such that there exists a material issue of dispute fact."



    Although it's Tohme who prevailed on the motion, the decision isn't a really loss for the estate as the court found the oral agreement regarding the mutual release to be binding as well. So Tohme will get his $3 million and the estate will get the assurance that they won't be engaged in anymore litigation with him.

    Michael Jackson Accuser’s Case Dismissed Once Again

    A California judge dismissed, without room to amend, James Safechuck’s claim against Michael Jackson’s corporations.

    Safechuck, along with Wade Robson, alleged that Michael Jackson’s companies MJJ Ventures and MJJ Productions were responsible for the “most sophisticated child sex abuse operation in history”.

    Robson and Safechuck are essentially arguing that these companies were formed solely to procure children for Michael Jackson to abuse, and are now seeking financial compensation (of undisclosed numbers) for negligence and inflicted emotional distress.

    Their attempts to collect financial compensation (despite apparently not wanting money for Leaving Neverland) from the Michael Jackson Estate is what film director Dan Reed says they consider “justice”.


    However, after 7+ years of claims, not a single corroborating witness has been found to substantiate the claims of Robson or Safechuck.


    Their initial cases targeted the Michael Jackson Estate, with Robson arguing that he waited so long to file his lawsuit because he did not know he could sue the Michael Jackson estate.

    In that case, the judge ruled that “no rational fact-finder could possibly believe” Robson’s sworn statement. The next cases, then targeting MJJ Productions and MJJ Ventures, were again dismissed in 2017.


    In his recently amended complaint, Judge Young determined that the claims against MJJ Productions and MJJ Ventures have not been adequately argued and that Jackson’s corporations could not be held responsible for the alleged actions of Michael Jackson himself.

    It is Safechuck’s third time being dismissed by a California court.

    It is also the second judge to review their cases and rule a dismissal.

    Wade Robson, whose claims and arguments are almost identical to Safechuck, is likely to be dismissed as well. Both men have continuously added to their claims over the years, even though corroborating witnesses and evidence have consistently failed to materialize.


    However, even after seven long years of failed litigation, Vince Finaldi (Safechuck and Robson’s lawyer) is likely to file yet another appeal on Safechuck’s behalf.


    Though Leaving Neverland brought more public attention to James Safechuck and Wade Robson, it has failed to give their claims anymore leeway through the court system as they’d hoped. It is likely, however, that both men will continue to exhaust their options in their quest for financial compensation.

    Michael Jackson should be pleased wherever he is today. The first of two cases brought against him posthumously by men who said they were abused by the singer in their teens was dismissed.

    The case of James Safechuck was dismissed on demurrer, meaning just through paperwork, on Tuesday.
    Judge Mark Young wrote, explaining demurrers: When considering demurrers, courts “are required to construe the complaint liberally to determine whether a cause of action has been stated, given the assumed truth of the facts pleaded.”

    You can read the Judge’s complete finding here. But he didn’t buy that Safechuck, as a child, worked for Michael Jackson or his companies, and that Jackson failed “to warn, train, or educate” him. Safechuck’s case, like that of his pal Wade Robson, was concocted to get money from the Jackson estate because Michael– who died suddenly– failed to leave them anything in a will.

    The judge wrote that: “Plaintiff [Safechuck] alleged that Jackson was “hired” by Defendants to coach, teach, and mentor minors interested in the entertainment industry. Setting aside Plaintiff’s allegation that Jackson was the President of both Defendants, Plaintiff has failed to allege specific facts detailing what such mentorship looked like (or was supposed to look like) from 1988 through 1992.”

    The case has been tossed and it’s not coming back. Howard Weitzman, Jackson’s estate lawyer, said in a statement to Showbiz411: “We are pleased that the court agreed that James Safechuck case should be dismissed because [they] had no grounds to pursue his lawsuit.”
    Robson’s case will be decided next. Each of these men participated in the disastrous documentary “Leaving Neverland,” in which they described– without evidence or backing or a chance for the estate to refute–child molestation at the hands of Michael Jackson. This was a decade after they’d attended Jackson’s funeral, many years after Robson testified for Jackson in a child molestation trial. They each seemed motivated to find money at the expense of truth.

    The documentary, shown on HBO, has been derided by Jackson fans who’ve meticulously pulled it apart and examined all the testimony of Safehuck and Robson. It’s like having a thousand Perry Masons working at once. yes.gif cool.gif

    Now the film’s director, not satisfied to have participated in one painful farce, is trying to make sequel. Since the Jackson estate is still suing HBO, it’s unlikely he’ll find a home again there anytime soon.

    Jimmy Safechucks Klage zum dritten Male abgewiesen


    Die Millionen-Klage von Leaving Neverland Darsteller James Safechuck wurde am 20. Oktober 2020 zum dritten Male abgewiesen. Richter Mark A. Young entschied nach einer letzten Anhörung, dass der Kläger seine Anschuldigungen und sein Anstellungsverhältnis gegenüber Michael Jacksons Unternehmen „MJJ Productions“ und „MJJ Ventures Inc.“ nicht beweisen könne. James Safechucks Klage aus dem Jahr 2014 gegen Michael Jacksons Unternehmen wurde Ende 2019 erneut eingereicht, nachdem der kalifornische Governeur Gavin Newsom ein Gesetz unterzeichnet hatte, das die Verjährungsfrist mutmasslicher Opfer verlängert.


    Anfang Januar 2020 wurde die Klage gemeinsam mit derjenigen von Wade Robson gutgeheissen. Am Superior Court of California wurden die Klagen seither geprüft und Kläger sowie Verteidigung angehört. Richter Mark A. Young kam nun zum Entschluss, dass James Safechuck und sein juristisches Team um den Anwalt Vince W. Finaldi keine Fakten vorlegten, die ihre Hauptargumente untermauern würden. So machten sie geltend, dass die Angestellten von Michael Jacksons Unternehmen eine Verpflichtung hatten, das Verhalten ihres Bosses zu überwachen und zu maßregeln, als er Safechuck angeblich missbraucht haben soll. Die Mitarbeiter der Unternehmen hätten die Pflicht gehabt, ihn – Safechuck – zu schützen.


    Doch James Safechuck und sein Anwalt konnten keine Verfehlungen dieser Mitarbeiter belegen. Die Firmen können nicht für angebliche Verfehlungen Michael Jacksons haftbar gemacht werden. Der Prozess von Wade Robson gegen Michael Jacksons Firmen soll am 14. Juni 2021 beginnen. Der Anwalt von Jimmy Safechuck behält sich nach wie vor die dritte Berufung vor. Dabei ist zu beachten, dass die Kosten zulasten der abgewiesenen drei Gerichtsverfahren zulasten der Kläger und seinem Team gehen. Damit sind Schulden gegenüber dem Estate von #MichaelJackson in Millionenhöhe angewachsen. Die Chancen für eine dritte Berufung sind sehr gering.

    HBO vs. Estate of Michael Jackson


    An 19. November 2020 finden die endgültige mündliche Anhörung über Videokonferenz in Pasadena, Kalifornien statt. Jede Partei hat 15 Minuten Zeit zur Argumentation. Das Urteil des Richters wird Anfang 2021 erwartet. Hier geht es um einen bestehenden, nicht gekündigten Vertrages zwischen Michael Jackson und HBO und einen Vertragsbruch wegen LN. Der Estate of Michael Jackson fordert die Verhandlung vor einem Schiedsgericht wegen Vertragsbruch und des damit verbundenen Schadensersatzes.

    Dokumentation der Gerichtsverfahren von Dan Reed soll behindert werden


    Der Regisseur von LN Dan Reed arbeitet ebenfalls an einer Dokumentation im Auftrage des britischen TV-Kanals Channel 4 - einen HBO-Ableger. Da die Mockumentary LN wie bewiesen nicht auf Fakten basiert, sondern ein fiktiver Film zur Unterstützung der Gerichtsverfahren der beiden Ankläger war, mit dem Ziel die Meinung der Öffentlichkeit gegen Michael Jackson einzustellen, hat der Anwalt vom Estate of Michael Jackson, einen Antrag gestellt, um die Zulassung vom "Leaving Neverland" Regisseur im Gerichtssaal aufzuheben.


    Dan Reed und dessen Produktionsfirma "Amos Pictures" dürften nicht als "Medien" oder als "Medien Agentur" definiert werden. Dabei wird die Mockumentary "Leaving Neverland" und das Nicht-Vorhandensein von Fakten zur Argumentation benutzt, die belegen soll, dass vom umstrittenen Regisseur keine ausgewogene Berichterstattung erwartet werden dürfe. Die Verhandlung betreffend Dan Reeds Zulassung im Gerichtssaal ist für den 9. April 2021 angesetzt.


    Von der Presse wie immer nicht erwähnt ist eine weitere Dokumentation von Journalist Larry Nimmer über die bestehenden Gerichtsverfahren. Der Journalist Larry Nimmer hatte bereits für den Prozess im Jahr 2005 auf Neverland Aufnahmen gedreht, die von der Verteidigung im Gerichtssaal dann den Jury-Mitgliedern gezeigt wurden. Larry Nimmer, ebenfalls vom Gericht zugelassen diese 2020/2021-Gerichtsverfahren zu dokumentieren, hat wie Dan Reed mit den Dreharbeiten Vorort begonnen.

    This is the end of an era for us Michael Jackson Fans.

    Sony/ATV Music Publishing has rebranded to Sony Music Publishing, returning to its original name after 25 years.


    The rebrand comes with a new logo and mission statement which, according to a statement, “further aligns the business with Sony’s powerful entertainment brands”.


    “The central visual of the new brand identity is a refreshed logo, which is designed as an abstraction of sound waves – with resonance and vibrations that express infinitely expanding opportunities for songwriters. Complementing the symbol, the Sony Music Publishing ethos is ‘every voice matters’, elevating the vision and goals of songwriters,” the statement said.

    Sony Music Publishing merged with the Michael Jackson-owned ATV Music in 1995. Jackson had acquired ATV in 1985, and by extension the Northern Songs catalogue which included the rights to songs written by John Lennon and Paul McCartney during their time with The Beatles. Sony acquired the Jackson estate’s share of Sony/ATV in 2016, making it a wholly-owned Sony company.


    The rebrand was driven by Sony Music Publishing CEO Jon Platt.


    “Since its inception, Sony Music Publishing has supported the careers of songwriters and continues to defend their rights,” Platt said.


    “Returning to the Sony Music Publishing name reconnects us to our legacy and further unifies our mission and culture with the Sony Corporation. Our new brand embodies a modern vision to be an authentic reflection of the music and songwriters we represent.”


    Sony Music Publishing’s catalogue includes artists such as Michael Jackson, The Beatles, Queen, Carole King, Ed Sheeran, Beyoncé, Lady Gaga and Kanye West, among others.
