    Edit: habs gesehen, bitte verschieben.

    Hatten wir das schon?

Veteran music producer Quincy Jones prevailed on Wednesday in his
dispute over unpaid royalties with the estate of Michael Jackson.

A Los Angeles jury awarded Jones $9.42 ($9,423,695) million in damages,
finding that he had been underpaid in royalties for music used in the
“This Is It” documentary and two Cirque du Soleil shows.

Jones first sued in 2013, alleging that he was unfairly cut out of
posthumous deals by Jackson’s estate to feature his music in the 2009
film and the Cirque shows. He said he was owed $30 million.

During the two-week trial, attorneys for both sides quibbled over how to
interpret contract language that governed how Jones’ royalties were
    calculated.

Jones took the witness stand last week — entering the courtroom in a
wheelchair — to explain his views on how he was “cheated out of a lot of
money” by the Jackson estate. At issue was the interpretation of two
contracts for the albums “Off the Wall,” “Thriller,” and “Bad.” Jones’
lawyers contended that his contracts entitle him to significant proceeds
from “This Is It,” the backstage concert film released after Jackson’s
death, as well as those from two Cirque du Soleil shows.

In handing down their verdict, the jury did not redefine what a “record”
is. On the question of whether the Cirque shows or “This Is It” were
considered “records,” the jury said no. As to what comprises a “video
show” — “This Is It” is applicable, but not the Cirque performances.

Representing the Jackson estate, Howard Weitzman argued that Jackson
himself made major contributions to the sound of each song, which
rankled Jones, who testified that producers often take the blame for
failures while artists get credit for hits.

Currently, the court is polling the jury on how they each answered the 28-question verdict form.

Following the verdict, Jones released the following statement:

“As an artist, maintaining the vision and integrity of one’s creation is
of paramount importance. I, along with the team I assembled with
Michael, took great care and purpose in creating these albums, and it
has always given me a great sense of pride and comfort that three
decades after they were originally recorded, these songs are still being
played in every corner of the world. This lawsuit was never about
Michael, it was about protecting the integrity of the work we all did in
the recording studio and the legacy of what we created. Although this
judgement is not the full amount that I was seeking, I am very grateful
that the jury decided in our favor in this matter. I view it not only as
a victory for myself personally, but for artists’ rights overall.”

Jury foreman Duy Nguyen, 28, said the contracts were the strongest
pieces of evidence the jury considered, and said hearing Jones'
    testimony was also helpful.
He said he and many members of the jury are Jackson fans, but that didn't factor into the deliberations. He said the verdict amount was a compromise figure based on an expert's testimony.

    From Billboard - http://www.billboard.com/articles/ne...tate-9-million

Following the verdict, Howard Weitzman and Zia Modabber, attorneys for
the estate of Michael Jackson, said Jones should not have received the
sum. "While the jury denied Quincy Jones $21 million – or more than
two-thirds of what he demanded -- from The Estate of Michael Jackson, we
still believe that giving him millions of dollars that he has no right
to receive under his contracts is wrong," the pair said in a statement
    issued to Billboard.

The statement continues, "This would reinterpret the legal language in,
and effectively rewrite, contracts that Mr. Jones lived under for more
than three decades, admitted he never read, referred to as 'contract,
montract,' and told the jurors he didn't 'give a damn' about. Any amount
above and beyond what is called for in his contracts is too much and
unfair to Michael’s heirs. Although Mr. Jones is portraying this is a
victory for artists’ rights, the real artist is Michael Jackson and it
is his money Mr. Jones is seeking." :D

He sat on my bed looking very handsome, dressed all in black. He had not yet gone over the top in his facial surgeries,” writes Sager. “He was quite beautiful looking in a Diana Ross way. He had not altered his skin tone and he had not yet begun to sabotage his career. Still, he was afraid.”

Jackson allegedly told Sager that he was shy, so she suggested he stay in her room. When Jackson finally joined the party, “he never left Elizabeth’s side, even holding her hand for most of the evening,” writes Sager.

“I had real empathy for him and the unloved childhood his abusive father robbed him of,” writes Sager. “As Elizabeth often said, she connected with Michael on a soul level because they were both deprived of a childhood by early stardom, yet they each looked at life at times through the eyes of a child.”

According to They’re Playing Our Song, one of her last interactions with Jackson occurred in 2006, at a party held by Barbara Davis. Even for Sager, who had partied and worked with celebrities for years, the evening was surreal. Marvin Hamlisch, Sager’s ex-boyfriend, fell asleep at the table and their host, Davis, looked like she was about to as well, writes Sager. Even though Michael Jackson’s two young children were present at the table, he also nodded off. According to Sager, Jackson said he was exhausted because he had been traveling in the Middle East. In reality, Sager writes that she learned Jackson had “been home for three weeks and was on some heavy narcotics” that caused him to slur and fall asleep.

So when Sager learned of Jackson’s death on June 25, 2009, she wasn’t shocked — “just terribly sad.” Elizabeth Taylor, in contrast, was inconsolable. According to Sager, she held Taylor’s hand as “she cried through the whole telecast.” Sager feels that “losing Michael accelerated [Taylor’s] decline.” Taylor died less than two years later, in 2011.

Sager continues to mourn the loss of both her celebrity friends. To her, Elizabeth was great because of her “humanity,” while Jackson was a “phenomenon.”

“Singular in his stunning talent and stunted beyond measure in the rest of his life,” Sager writes. “And to the extent that he was capable of love, I believe he loved his children, his mother, and he loved Elizabeth.”

Es wurde dann Heal the world gespielt.
