Michael Jackson's Licensing Issues
2008. december 26.
Updates to my December 6th, 2008 post regarding Michael Jackson's licensing business issues:- Jackson's original licence owner company "Triumph International Inc." (TI) has been suspended for sure both in California and Delaware. However in the very same year someone registered "Triumph International LLC" in Delaware. It's still unclear if the second company does belong to Jackson.
- It seems that "TI" is still the sole licence owner of Jackson's merchandising rights worldwide, however "TI" sold these rights in Europe to "MJ Licensing LLC" (MJL) until June 2012. Jackson most probably has a 75% stake in MJL.
- Jackson has established "MJ Marketing (Asia-Pacific) PTE LTD" (MJM) through "TI" back in 2002. The company is still active and handles Jackson's merchandising businesses in Asia ("MJ Japan", the Japanese clothing line, the new Thriller figures all does belong to "MJM").
- I have reported about another merchandising company of Jackson's called "Michael Jackson Mystery Holding Ltd". The Hong-Kong based company once responsible for the "Mystery" drink has been suspended this August.
- "MJ Company LLC" is still a mystery for many reasons. The company is still active in California, and was responsible for Jackson's touring plans after the "HIStory" era.
There is still a lot to do with Jackson's merchandising businesses. It seems that the star and his people has to negoiate with third parties to resolve these matters.

Schaffel vs. Jackson Case dismissed
There was a hearing on this around the 23rd December. I presume MJ's team didn't get what they wanted, so either the judge dismissed their filings or they asked for it to be dismissed as it wasn't gonna get anywhere.
Very old case, long story. Schaffel sued Michael Jackson over money owed for work on, I think the home movies and 'what more can i give', MJ counter sued Schaffel as he had been writing himself cheques etc.

ZitatAlles anzeigenStatus of MJ vs. Universal Music Group?
I started a thread way back in July 2005 about MJ's legal action against Universal Music Group. I couldn't work out whether I could re-activate that thread.
I haven't heard anything about the action in a long time. The most recent article I posted in that previous thread referred to the Judge allowing claims of breach of contract and accounting to proceed. Does anyone know what the current status of the action is or whether it was ever finalised?
-> The case has been dismissed back in 2004 for MJ's request.

Tuesday, 13 January 2009Access Hollywood reports that Billie Jean Jackson is suing singer Michael Jackson for the second time.
In 1987, 60-year-old Billie Jean filed a $150 million paternity suit against Michael claiming he's the father of three of her children. The suit was thrown out of court.
Now, Billie Jean, whose real name is believed to be Lavon Powlis, claims she's married to Michael and the mother of his six-year-old son, Prince Michael II. She's reportedly seeking $1 billion and joint custody of the child, who goes by the nickname Blanket.

Updates in the Syl Johnson Case
It's in relation to "Blood on the Dance Floor" which allegedly samples one of his tracks without permission--although the only version of this track which appears to sample his work at all is the Refugee Camp Mix (produced by Wyclef Jean and Pras Michel) yet they weren't even named as defendants nor was this specific remix mentioned...he filed this suit against a bunch of other artists including Tupac Shakur (estate of) for a variety of songs that he claims use his sample without permission or compensation. It only took him an entire decade after the remix was released to file such a suit .
More details (and the complaint itself) at: Michael Jackson Repository News / Comments / Lawsuit Filed By Syl Johnson Against Michael Jackson, Will Smith, and Others
Lawsuit Filed By Syl Johnson Against Michael Jackson, Will Smith, and Others
71-year old Soul singer Syl Johnson (Sylvester Thompson) has filed a lawsuit in an Illinois district court, where he accuses numerous artists of sampling his 1967 song "Different Strokes" without proper authorization to do so. In the lawsuit, Johnson lists Michael Jackson, Will Smith, (the estate of) Tupac Shakur, KRS One / Boogie Down Production, Peedi Crakk & Young Chris, and the group N.W.A. as defendants along with their respective music labels.
Of the alleged copyright infringement, Syl Johnson contends that the above mentioned artists stole portions from "Different Strokes" and used them in their own work(s), without offering any compensation nor obtaining any sort of authorization to do so from Johnson. In the complaint, Syl Johnson requests a jury trial and asks for an unspecified amount in damages.
Johnson primarily names the following songs and artists as infringing upon his rights:
Blood On the Dance Floor (Michael Jackson)
Who Stole the D.J. (Will Smith)
Peep Game (Tupac Shakur)
Nothing But Love (Tupac Shakur)
Criminal Minded (KRS One)
Criminal Background (Peedi Crakk & Young Chris)
Real Niggaz Don't Die (N.W.A.)It is worth noting that, in the legal complaint, Johnson referenced the Michael Jackson track simply as "Blood On the Dance Floor." However, the original version of the song (and title track to Jackson's 1997 remix album) does not appear to use any audible samples of Syl Johnson's work. Instead, it is the Refugee Camp Mix of the song (produced by The Fugees' Wyclef Jean and Pras Michel) that samples the opening vocals from "Different Strokes." The remixed version of this song was included on the original single release, but not on the album itself. Why none of The Fugee members were named defendants has yet to be made clear.

2SeasRecords:
Re: 2Seas, their Web site changed within 1-2 weeks after the lawsuit was settled. I don't care what happens with it, all I hope is that as part of the confidential settlement Michael didn't agree to be any part of that non-existent company at any point in the future. When news first broke that he was going to record the Katrina single on that label (soon after the trial) the site underwent a similar "coming soon" transition from its original state. Then it promoted the single and "company" with a flashy animation, and then when things fell apart it all went away and remained as such for a couple years. Now it looks like they'll be bringing it back in one form or another.

LOS ANGELES UNIFIED SCHOOL DISTRICT
The school has a Web site, but their contact form does not work and has not forever. I've tried to contact them about this some time back, but I feel that they'd listen more carefully if the person (or group of people) contacting them are actually from the area and not from distant states. The cover was never meant to be permanent, at least two high up people from the district said as much when they so quickly covered it up in November 2003.
Stephanie Brady (District Spokeswoman) said that they would cover it "for the time being" until the case was over, while implying that it would be removed if he was exonerated. Celia Ripke (Principal) echoed similar remarks, and that she felt Michael was innocent until proven guilty.

"To whom it may concern; I am writing to inquire about the "Michael Jackson Auditorium" at your school, which was dedicated in October 1989. In November 2003, the school covered Michael Jackson's name on the building due to the then pending allegations against him. Stephanie Brady (the district spokesperson) was quoted at the time as saying that his name would be covered up "for the time being" until the case was concluded. It was suggested by both Ms. Brady and Principle Celia Ripke that they believed in "innocent until proven guilty" and if Michael Jackson were acquitted, as he ultimately was, the title would be restored. Years have gone by and still the auditorium is covered up. I am writing to ask what the status of this issue is, and if there are any considerations to remove the cover over his name or why it is still covered? The family that accused Michael Jackson in 2003 admitted to having lied under oath in the past for financial gain, the mother was subsequently convicted of multiple counts of welfare fraud and perjury, and Michael Jackson was acquitted on all charges. Thank you for your time."

African singer sues Michael Jackson and Rihanna
1 hr 12 mins ago
PARIS (AFP) – Cameroonian singer Manu Dibango lodged a lawsuit against king of pop Michael Jackson and R'n'B diva Rihanna at a Paris court on Tuesday, claiming they stole a hook from one of his songs.
French judges will decide on February 17 whether to allow the 75-year-old African's case against the artists to be heard. He is reportedly seeking 500,000 euros in damages.
Jackson had already accepted that parts of Dibango's 1972 "Soul Makossa" were used on the track "Wanna be Startin' Something" on the 1983 album "Thriller," and the singers had reached a financial settlement.
But in 2007, Rihanna -- apparently in good faith -- obtained Jackson's permission to use the same section of melody on her hit single "Please don't stop the music," without also contacting the original artist Dibango.
Separately, Paris-based Dibango's lawyers have asked the French courts to block record labels Sony BMG, EMI and Warner from receiving any income from the records until the matter is settled.

Jackson, Rihanna Sued for Song Swipe
Josh Grossberg – 1 hr 48 mins ago
Los Angeles (E! Online) – Michael Jackson started somethin' all right. Another legal battle.
In the latest in a never-ending string of lawsuits, a Cameroonian musician is suing Jackson and Rihanna in a Paris court, alleging they swiped a hook from one of his tunes.
The suit, file Tuesday by 75-year-old Manu Dibango, claims the Moonwalker had previously acknowledged using a section of Dibango's 1972 track "Soul Makossa" as the riff on "Wanna Be Startin' Something," one of the hit singles from 1983's landmark Thriller album. The two sides eventually reached a settlement over the unauthorized sample.
Rihanna came to be involved in the dispute in a roundabout way. Turns out she licensed the same hook from Jackson for her 2007 smash "Don't Stop the Music," but no one bothered to get permission from Dibango.
According to Agence France-Presse, a Parisian court will rule on Feb. 17 whether the case will move forward.
Should he win, Dibango could net more than $600,000. Until the matter is adjudicated however, his attorneys are asking the court to block Sony BMG, EMI and Warner from profiting off the contested songs.
There was no immediate comment from either Jackson or Rihanna.
Jackson was sued just last week by "Thriller" video director John Landis for failing to pay royalties from his the 14-minute clip and then trying to launch a stage version of the video without Landis' input.

Update: Helen Harris-Scott's Case
In related news, that other nutjob Helen Harris-Scott's case is still active (pending appeal) with yet another hearing on it in Santa Monica today...despite the judge dismissing the case nearly two years ago. Amazing how much money Michael spends each year on defense litigation alone for such false and ludicrous lawsuits.
