ZitatAlles anzeigenFreedom of speech is a civil liberty that is very protected in the US. The first Amendment of the constitution states that "Congress shall make no law... abridging the freedom of speech, or of the press", yet that freedom has been limited in some respects. For example, the 'clear and present danger test' (forumlated by Justice Oliver Wendell Holmes in the Supreme Court's unanimous decision in Schenck vs. United States in 1919) clarifies the advocacy of ideas from incitement, which is not constitutionally protected.
However, in other areas, a great deal of latitude is given. For example, the freedom of the press is virtually invincible in the US. Since the Supreme Court's decision in 1964 in the case of New York Times vs. Sullivan, the press can defame an individual so long as that person is a public official. The court ruled that the first amendment protected all statements- even FALSE ones- about public officials (except statements made with actual malice) because the court felt that "even a false statement may be deemed to make a valuable contribution to public debate".
Three years later, the right of the press to defame individuals extended to all PUBLIC FIGURES (such as celebrities). Since then, these people must show actual malice in false statements printed about them and because the burden of proof is so high, few plantiffs prevail and freedom of the press is the beneficiary.
And in 1988, the Supreme Court ruled on the damage that is not to one's reputation, but to one's emotional state. In a unanimous decision, the SC rulled that even "vehement, caustic, and sometimes unpleasantly sharp attacks" were protected by the first amendment.
So, for people who wonder why Michael doesn't sue over tabloids more- that's why. The constitution of the US (as interpreted by the Supreme Court) basically gives the press the right to print offensive, even false statements and so people like Michael are pretty much just screwed.

Da kann man rechtlich sicher was machen.

ZitatAlles anzeigenCalifornia Civil Code § 1708.7, 1993. Amended 1998.
Stalking
(a) A person is liable for the tort of stalking when the plaintiff proves all of the following elements of the tort:
(1) The defendant engaged in a pattern of conduct the intent of which was to follow, alarm, or harass the plaintiff. In order to establish this element, the plaintiff shall be required to support his or her allegations with independent corroborating evidence.
(2) As a result of that pattern of conduct, the plaintiff reasonably feared for his or her safety, or the safety of an immediate family member. For purposes of this paragraph, "immediate family" means a spouse, parent, child, any person related by consanguinity or affinity within the second degree, or any person who regularly resides, or, within the six months preceding any portion of the pattern of conduct, regularly resided, in the plaintiff's household.
(3) (3) One of the following:
(A) The defendant, as a part of the pattern of conduct specified in paragraph (1), made a credible threat with the intent to place the plaintiff in reasonable fear for his or her safety, or the safety of an immediate family member and, on at least one occasion, the plaintiff clearly and definitively demanded that the defendant cease and abate his or her pattern of conduct and the defendant persisted in his or her pattern of conduct.
(B) (B) The defendant violated a restraining order, including, but not limited to, any order issued pursuant to § 527.6 of the Code of Civil Procedure, prohibiting any act described in subdivision (a).
(b) For the purposes of this section:
(1) "Pattern of conduct" means conduct composed of a series of acts over a period of time, however short, evidencing a continuity of purpose. Constitutionally protected activity is not included within the meaning of "pattern of conduct."
(2) "Credible threat" means a verbal or written threat, including that communicated by means of an electronic communication device, or a threat implied by a pattern of conduct or a combination of verbal, written, or electronically communicated statements and conduct, made with the intent and apparent ability to carry out the threat so as to cause the person who is the target of the threat to reasonably fear for his or her safety or the safety of his or her immediate family.
(3) "Electronic communication device" includes, but is not limited to, telephones, cellular telephones, computers, video recorders, fax machines, or pagers. "Electronic communication" has the same meaning as the term defined in Subsection 12 of § 2510 of Title 18 of the United States Code.
(4) "Harass" means a knowing and willful course of conduct directed at a specific person which seriously alarms, annoys, torments, or terrorizes the person, and which serves no legitimate purpose. The course of conduct must be such as would cause a reasonable person to suffer substantial emotional distress, and must actually cause substantial emotional distress to the person.
(c) A person who commits the tort of stalking upon another is liable to that person for damages, including, but not limited to, general damages, special damages, and punitive damages pursuant to § 3294.
(d) In an action pursuant to this section, the court may grant equitable relief, including, but not limited to, an injunction.
(e) The rights and remedies provided in this section are cumulative and in addition to any other rights and remedies provided by law.
(f) This section shall not be construed to impair any constitutionally protected activity, including, but not limited to, speech, protest, and assembly.

Zitat(2) "Credible threat" means a verbal or written threat, including that communicated by means of an electronic communication device, or a threat implied by a pattern of conduct or a combination of verbal, written, or electronically communicated statements and conduct, made with the intent and apparent ability to carry out the threat so as to cause the person who is the target of the threat to reasonably fear for his or her safety or the safety of his or her immediate family.

ZitatI would do something more humiliating to Roger! Suing is too easy and costs a bunch load of money... I would use the legal system and have a restraining order placed against him. Grace is a private citizen and she is being stalked by a gossip columnist. He is saying terrible things about this woman and it could be causing psychological stress. There is evidence that he is stalking her ... he's finding out living arrangements, who she was/is married to, accusing her of peddling drugs to Michael, saying that she's virtually kidnapped Michael, etc. I would have my attorney issue a cease and desist letter and if he didn't quit, a restraining order. The proof is overwhelming that he is LITERALLY harassing her and causing her image (and again, she is a private citizen) incredible damage.

Und ein Statement von Angel Howasnky (Jackson Family Publisist) zu den Friedman-Artikeln:
ZitatSince the new article is surrounding the family, I would like to see Ms. Angel Howansky (Jackson Family Publicist) come out with a STRONG denial about Roger Friedman's new story. After all, he's squarely placing his source within (or around) the Jackson Family. Someone associated with the family needs to say SOMETHING about this not being true. It will force Roger's hand because he'll feel two-timed and will squeal about his source. He did it before with the korean business man that jacked MJ.

ZitatHi all.. I just brought this to Angel's Attention. She issued the following statement to post:
