Falsche Heal The World Stiftung von MJ Estate verklagt

  • MJ Estate Stops 'Heal the World' Copycat

Score another crushing victory for the Michael Jackson estate -- this time the MJ squad dropped the hammer on a woman who allegedly set up a sham Heal the World Foundation to dupe Jackson fans into buying merchandise.

TMZ has learned a Federal judge issued an injunction against Melissa Johnson -- the woman behind a Heal the World Foundation website -- requiring her to stop "exploiting Michael Jackson's name, image and likeness."

According to the court order, the judge ruled that Johnson -- who has attempted to register at least 40 trademarks with a direct connection to MJ -- operates websites that "convey to consumers a false affiliation with Michael Jackson."

As you may recall, Jackson operated a legit Heal the World Foundation back in the day, but it had been inactive for many years prior to his death.

    lol.
haben wirs nicht schn lange gewusst...? :Q

  • Michael Jackson Estat erwirkt einstweilige Verfügung gegen „Heal the World Foundation“.

Michael Jackson Estate Settles with Heal the World

4/19/2011 9:25 AM PDT by TMZ Staff

The Michael Jackson Estate has settled its lawsuit against the Heal the World Foundation, and the Estate is now copacetic with the charity using Michael Jackson's name.

The Estate had sued Heal the World, on grounds it had no right to use MJ's name to solicit money. But we've learned there was a secret meeting yesterday between Katherine Jackson's new lawyer, Perry Sanders, and Estate lawyer Howard Weitzman.

We're told the Foundation will transfer to the Estate all registered trademarks that relate to Michael Jackson. MJ's original Heal the World Foundation will be re-formed under the supervision of the Executors. Katherine Jackson will be a member of the board, as will Melissa Johnson, who headed up the most recent version of the foundation.

The lawyers are going to court this AM to dismiss the lawsuit.

  • Michael Jackson Lawyers 'Take Back' Trademarks

Michael Jackson's estate executors have dismissed reports they've agreed to allow bosses of the Heal the World Foundation to use the King of Pop's name,
insisting they are "taking back" all the Thriller hitmaker's trademarks.

Reports on Tuesday (19Apr11) suggested officials at the organisation had worked out a deal with Jackson's executors on Monday (18Apr11)
allowing them to utilise the pop superstar's moniker.

But lawyers involved in the case have now spoken out, insisting Heal the World Foundation owner Melissa Johnson is barred from using Jackson's name.

A spokesman for the estate executors tells WENN, "The estate is taking back the Heal the World Foundation and all of the Michael Jackson trademarks it allegedly owned.
The Michael Jackson Estate owns the Heal the World name, and neither Melissa Johnson nor her companies will ever be able to use Michael Jackson's name or the Heal the World name."

MJ Estate vs HTWF Updates :

    - Estate and HTWF began discussing a settlement on April 16th. They signed a binding agreement on April 19th - the first day of trial.

    - Judge gave them a month ( May 19th) to file a status report about the settlement.

    - Today Estate filed a document with the court saying that they wouldn't be able to file the status report on May 19th because

---- HTWF hasn't done anything they are supposed to do
---- HTWF breached the confidentiality as some items were also copied to Howard Mann
---- They received an email from Mel Wilson of HTWF on May 13 saying there was a board of directors meeting on May 6th and that Board of Directors reject and rescind the Settlement
Agreement as Melissa Johnson didn't have the permission and authority to act on behalf of Board of Directors (Katherine and Joe are a part of board of directors).

    - MJ Estate is planning on filing a motion by May 19th asking the judge to enforce the Settlement Agreement. There will be a hearing about it if possible by mid- June.

sonst wäre das damals sicher anders ausgegangen.

    Updated: Estate vs Melissa Johnson

On May 14th, 2011 the MJ Estate has been notified about that the defendants do not intend to follow their obligations under the settlement agreement. They are claiming that Melissa Johnson did not have the authority to sign the settlement agreement in the name of board of directors.

Since the parties agreed in settling the case, defendants didn’t follow any of the settlement terms. Johnson’s lawyer insisted that they have concerns regarding the terms of the settlement. This lawyer insterestingly sent a copy of this communication to Howard Mann, that tells a lot.

The fact that the board of directors rejected the settlement means that both Katherine and Joseph Jackson was present and voluntary agreed to this, and plays on fighting again the MJ Estate.

    Update 2:

The MJ Estate filed it’s answer on Brian Oxman asking for $4.000 reimbursment, becuase he appeared for a deposition back in February.

The MJ Estate amongst others claims:
    - Oxman tried to avoid to be served with the subpoenas,
    - He refused to go to the deposition,
    - Failed to respond on the MJ Estate’s form about reimbursing costs for him,
    - He wanted to be part of this trial as he was submitting his witness statement to Johnson voluntary, later didn’t want to testify on their side,
    - No one locates on his office address, but a surplus store where he and his father are selling “anti-radiation” pills to the public following the earthquake in Japan,
    - According to the process server “Oxman took the subpoena papers when he was served, clearly realising he had been caught and had little choise but to accept”,
    - After Oxman received the subpoenas his wife e-mailed the MJ Estate lawyers saying that Oxman won’t be available on any of the dates mentioned,
    - The MJ Estate lawyers just found out that Oxman and his wife (and partner in their law firm) has a long history of sending mails that no one receives finally, when they are in trouble,
    - When the MJ Estate lawyers started to force him to appear for the deposition, he called them “incompetent”, “rude” and offensive”. When they were discussing the date of Oxman’s deposition,
if he will be available anytime he replied to the lawyer “well, aren’t you a brave young lady?”,
    - Oxman wants to get money, because of the costs of “binding” the documents he produced. However the documents were not binded in any ways, aside from being rubberbanded,
    - According to law Oxman has to be reimbirsed for around $100 that includes his travelling fees and so. This money has been sent to him 3 times over the past 2 months,
last time he has been personally served with the check. And now he claims that he didn’t get the money and wants $4.000,
    - Oxman claims that he spent 12.3 hours on searching and collecting documents for the deposition and counts with his alleged $500 fee. At the end Oxman appeared on the deposition
with only 5 documents, one of them was an empty envelope…
    - Oxman has been suspended twice, first time in 1998 for similar incidents. And in 2009 when the California State Bar suspended his licence for 2 years.
