Judge delays ruling on Jackson case

    MARY FOSTER
    Associated Press

NEW ORLEANS - A federal judge on Wednesday asked for more information before considering a motion from Michael Jackson's attorney to dismiss a Louisiana man's suit claiming he was molested by the pop star more than 20 years ago.

Jackson's lawyer, Charles F. Gay Jr., asked U.S. District Judge Eldon Fallon to dismiss the suit by Joseph Bartucci Jr., because the alleged incident happened more than 20 years ago.

Bartucci claims he was lured into Jackson's limousine in 1984 and held for nine days during which he was both sexually and physically assaulted.

There is a one-year statue of limitations on the crime for adults. Bartucci, who was 18 in 1984, argues the statute applies only from when he recovered a repressed memory of the event.

Bartucci claims he was sexually assaulted by Jackson and battered, held at gunpoint and cut with razor blades by Jackson's bodyguards during a drive to California and back. Bartucci asserts he remembered the incident only when he saw a Court TV show about child molestation charges brought against Jackson in California. Jackson was acquitted in that case.

"They have no facts or evidence to support the claim of repressed memory," said Gay, who said the notion of repressed memory is not supported by studies of medical experts.

Attorney Louis Koerner, argued that Bartucci was so badly injured by Jackson's bodyguards - including having his head slammed on the pavement - that the trauma caused him to blank out all memory of it.

"He went through a terrible, terrible, terrible time," Koerner told the judge.

Fallon asked Koerner to depose Dr. L. Mulry Tetlow, a psychologist who agreed that Bartucci had repressed the memory.

"I want to look at what he says about repressed memory," Fallon said.

Jackson's attorney's categorized Bartucci's claim as a "fantastic tale," in court papers seeking to have it dismissed.

Bartucci has a long history of litigation, they claimed, including being a party to 18 civil and criminal suits in the past 17 years.

"It's so hard to get a dismissal at this early stage," Gay said. "But we think this whole thing was conjured up by a guy who knows how to use the system."

:rolleyes

Custody Judge Says Jackson Committed Fraud

Issues include anti-Semitism and passport shenanigans
    By TMZ.COM STAFF

(Jan. 30) -- TMZ has obtained documents in Michael Jackson's custody case, in which the singer's lawyer accused the judge of being prejudiced against his famous client. In the legal papers, Jackson's attorney claims that Judge Steven Lachs made comments that Jackson "obtained passports for (his) children by the use of subterfuge."

In the papers, Jackson's lawyer claims the judge made other comments indicating bias, including:

-Jackson has been reported to have made anti-Semitic statements

-The Kingdom of Bahrain is the most or one of the most anti-Semitic countries in the world

-The Kingdom of Bahrain would make it difficult for Jackson's children to be Bar Mitzvahed

Lachs allegedly made the comments in a hearing last November in connection with Jackson's custody dispute with his former wife, Debbie Rowe. Rowe, who is Jewish, has expressed concern in the past about the religious infuences on her children while in Jackson's care.

In the papers, Jackson's lawyer Michael Abrams, wrote, "Judge Lachs is Jewish, as am I. He has made me aware of this in the past and I understand Judge Lachs' concern about anti-semitism and anti-Israel sentiments." Abrams takes issue with the comments, alleging no evidence was ever presented on issues of Jackson's alleged anti-Semitism.

Last November, ABC News aired phone messages in which Jackson allegedly said of Jews, "They suck - they're like leeches."

Last month, Jackson's lawyer filed papers demanding that Lachs withdraw from the case. Lachs stepped down last month.

    The custody dispute is ongoing.

    JACKSON 'JEWISH' FEAR

    By DAVID K. LI

LOS ANGELES — Michael Jackson's lawyer fears his client's past anti-Semitic remarks could be hurting the singer in his child-custody battle, a new report says.

Jackson has been fighting Jewish ex-wife Debbie Rowe over custody of kids Prince Michael, 8, and Paris, 7.

The celebrity news Web site http://www.tmz.com is reporting that Jackson family lawyer, Michael Abrams, wrote in secret court papers that The Gloved One's past anti-Semitic comments may work against him in his fight.

Rowe and Jackson agreed to air their case in front of a privately hired arbitrator, retired L.A. County Superior Court Judge Stephen Lachs.

Abrams, in previous court documents cited by the site, said, "Judge Lachs is Jewish, as am I. He has made me aware of this in the past and I understand Judge Lachs' concern about anti-Semitism."

In his song "They Don't Care About Us," Jackson says: "Jew me, sue me, everybody do me, kick me, kike me."

  • wahrscheinlich bin ich wieder mal total verpeilt, aber ich dachte, dass sich michael und debbie schon irgendwie geeinigt hätten. :?

Michael Jackson: New Lawyers Mock Old Ones

The revolving door of lawyers in the kooky world of Michael Jackson has gotten a little stranger lately.

Evidently off the case--and all cases--is Brent Ayscough, partner of loose cannon Brian Oxman. Also out is Michael Sydow of Houston, who was helping Thomas Mesereau in some of Jackson’s lawsuits. All of them were “finds†of Randy Jackson, Michael’s brother.

In, at least for now: Thomas C. Mundell of Westlake Village, California. I’m sure Mr. Mundell is a very good attorney, but for a pop superstar he’s not exactly Century City. Alas, Jackson has used everyone in Century City, Beverly Hills and its adjacent areas, so Westlake Village was next.

Mundell looks like a tough customer. He’s already filed a motion in court mocking all of Jackson’s previous reps. He writes that Ayscough has been “uncooperative†and refuses to turn over Jackson’s files. He also says that certain points so far in Marc Schaffel’s lawsuit with Jackson were Ayscough’s fault and that Sydow “has been hard to reach.†Sydow, Mundell says, “has been absolutely no help in filing this motion.â€

And what of Jackson? Yesterday he left Hamburg for Munich as we predicted, but is not expected back in Bahrain until February 10. None of his people have been able to reach him at all and no one knows where he is, exactly. Certain papers have to be signed by him in these ongoing cases. A hopeful Mundell writes to the judge: “Because Jackson lives in the Middle East, it can sometimes take a little longer to reach him that it would to reach a local party.â€

  • ANTI-SEMITISM COULD COST JACKSON

Pop superstar MICHAEL JACKSON's lawyer fears alleged anti-Semitics comments the singer made in taped voicemail messages could damage his child custody battle with ex-wife DEBBIE ROWE.

Jackson is reportedly heard calling Jews "leeches" in messages he left for a former advisor. Critics also accuse him of singing, "Jew me, sue me, everybody do me, kick me, kike me," in the track THEY DON'T CARE ABOUT US.

The accusations have already caused Jackson massive embarrassment and cost him the friendship of spoon-bender URI GELLER.

Now his Jewish lawyer MICHAEL ABRAMS fears it may cost him custody of PRINCE MICHAEL, eight, and PARIS, seven, his children with Rowe - in a forthcoming hearing in front of private arbitrator, retired judge STEPHEN LACHS.

According to website TMZ.com, Abrams wrote in secret court documents that the comments may work against him.

In previous documents, Abrams reportedly wrote, "Judge Lachs is Jewish, as am I. He has made me aware of this in the past and I understand Judge Lachs' concern about anti-Semitism."

  • Jackoson Employees File for Compensation

There's real concern about the remaining employees at Michael Jackson's Neverland Ranch. Yesterday marked six weeks since they received paychecks.

I'm told that one group has already filed a complaint with the California Labor Relations Board, and another one is about to follow suit.

Jackson, meanwhile, is vacationing in Venice, Italy with his 20-year-old protégé Anton Schleiter. They are no doubt having a ball.

Jackson is being underwritten by a Bahraini prince. The employees, sources say, are borrowing money to buy groceries and gas, hoping the situation will change.

One Neverland staffer has taken matters into his own hands.

Rudy Lozano, a cook at the ranch for seven years, opened Rudy's International Fast Food in nearby Nipomo, Calif., a couple of weeks ago. He's serving Mexican, American, Italian and Japanese food from 4 p.m. to 9 p.m and hoping to generate enough money to make ends meet. .

Lozano still supports Jackson, although his confidentiality agreement prohibits him from even saying Michael's name. He says of the Arvizo family, which brought the child molestation charges against Jackson for which the singer was acquitted last year, "One family destroyed 180 families."

He was referring, of course, to the Neverland staff.

"I am very sad," he said, "very angry."

  • February 6, 2006 -- LOS ANGELES — Lawyers want to pry open Michael Jackson's wallet and the singer's most private legal papers about his on-going child-custody battle, according to court documents.

The lawyer for ex-wife Debbie Rowe claims Jackson has fallen behind in his court-ordered obligation to pay her legal fees.

Rowe's lawyer Iris Finsilver and Jackson's legal eagle could not be immediately reached for comment. But in court papers, Finsilver claimed Jackson owes her more than $75,000.

Rowe and Jackson have been fighting over their children Prince Michael, 8, and Paris, 7. Jackson, 47, now has full custodial rights and has been living with his kids overseas since he was acquitted last summer of kiddie-sex charges in Santa Barbara County.

The family court is making Jackson pay Rowe's legal fees — a common order in cases where one side of a custody battle makes more money than the other. A hearing is set for March 17.
