Ein Berufungsgericht in Kalifornien hat einen Antrag des Vaters von Michael Jackson abgewiesen, ihm ein Mitspracherecht bei der Verwaltung des Erbes einzuräumen. Die drei Richter bestätigten am Dienstag in Los Angeles einstimmig die Entscheidung einer Vorinstanz, die eine Klage von Joe Jackson gegen die Nachlassverwalter nicht zuließ. Das Erbe wird vom Anwalt John Branca und dem Musikmanager John McClain verwaltet, so wie es Michael Jackson auch in seinem Testament von 2002 festgelegt hatte. Joe Jackson wurde dabei ausdrücklich ausgeschlossen und hat damit keinen Einfluss auf die Verwendung des Erbes, das seit dem Tod Michael Jacksons im Juni vergangenen Jahres um etliche Millionen Dollar angewachsen ist. Die Hauptbegünstigten des Testaments sind Michael Jacksons Mutter Katherine und seine drei Kinder.

Judge Declines to Hear Jackson's Wrongful Death Suit

A wrongful death lawsuit filed by Michael Jackson's father will be handled by a California state court after a federal judge insisted he does not have the authority to hear the case.

Joe Jackson launched legal action against Jackson's personal physician Dr Conrad Murray in August (10), accusing him of administering a fatal dose of anaesthetic Propofol, which led to the singer's death in June 2009.

Jackson alleges he was being supported by the Thriller hitmaker at the time of his passing - a claim which gives him the necessary legal standing to pursue a wrongful death suit.

At a federal court hearing on Monday (01Nov10), Jackson's attorney, Brian Oxman, agreed to dismiss a claim alleging the King of Pop's rights were violated under the Americans with Disabilities Act - prompting U.S. District Judge John F.

Walter to rule the remaining issues needed to be handled in a state court.

Oxman said he would refile the case in Los Angeles Superior Court.

The federal judge also said he would not delay the case until after theJanuary (11) criminal trial of Dr Murray, who has pleaded not guilty toinvoluntary manslaughter in the Thriller hitmaker's June, 2009 death.

Dann bestätigt sich mein Eindruck, dass das ganze auf nichts mehr als heißer Luft basiert.
Joe dachte wohl, er kann mit seinem Geschwafel irgendwen überzeugen - er ist ja schließlich DER JOE JACKSON!

Wie ich sowas hasse... Und zivilrechtliche Klagen sind ja bei sowas für die Kläger einfacher als eine strafrechtliche. Bleibt nur zu hoffen, dass das nicht irgendwie Einfluss auf die strafrechtliche Klage hat.

Joe Jackson has refiled his wrongful death lawsuit against Dr. Conrad Murray in Los Angeles in relation to his late son, Michael Jackson.

The King of Pop's father previously filed the lawsuit in a California state court but it was thrown out by the judge.

Jackson has now refiled the case in Los Angeles Superior Court alleging that Dr. Murray was negligent in administering the strong anaesthetic Propofol that killed the singer.

Joe is also suing Applied Pharmacy Services in Las Vegas that sold the drug to Murray.

In legal papers Joe Jackson alleges that Murray withheld vital information about Michael's health from paramedics who rushed to the scene to try and revive his son.

He also claims that Murray tried to hide evidence that he believes is relevant to the Thriller singer's death.

Vieleicht bekommt er das ja mit, schaden freude ist manchmal auch ziemlich lustig. Er wollte ja nicht umsonst das er keinen Cent bekommt sein "Vater".

So mein ich das auch nicht. Er wird doch gewusst haben das sein Vater wenn er wirklich vor ihm stirbt das der alte alles versucht um doch noch an MJ Geld zukommen. Es würde ihn freuen das er nichts von der Kohle bekommt, davon bin ich überzeugt.

The father of the King of Pop has once again asked for a full scale investigation on the death of his son.
With jury selection for the trial of Michael Jackson’s doctor about to begin, it was only a matter of time before a new story emerged on the topic.

This time it is from Jackson’s father, who has renewed his calls for a probe into his son’s death based on his beliefs of a conspiracy.

Joe Jackson was promoting a world tour of Spanish musical Forever King of Pop in Madrid, and said that he believes the doctor at the centre of the trial was acting on behalf of other people in Michael’s career.

Joe claims that Michael warned his family that he would be killed over the publishing rights of some of his biggest hits.

“I want a federal investigation so they can grab them all,” Joe Jackson said, claiming that Dr Murray is “just the fall guy” and other people should be brought to account for Michael’s death.

Joe refused to make a comment about the book about Michael his brother Jermaine is releasing in the autumn, as he is currently working on his own book that he hops to release about the “hard times” he had raising his family.
