Mother Of Jackson Accuser To Stand Trial For Fraud

(AP) LOS ANGELES The woman whose son claimed Michael Jackson molested him at Neverland Ranch was ordered Friday to stand trial on felony charges that she stole $8,000 from the government through welfare fraud.

Janet Arvizo, 37, waived her right to a preliminary hearing during an appearance in Superior Court. She is set for arraignment June 21 on a count of welfare fraud and four counts of perjury by falsely applying for welfare.

She answered "yes" when asked by the prosecutor if she waived her rights. She was released without bail.

The woman did not speak to reporters as she left. The Associated Press has withheld her name to protect the identity of her son because he has claimed to be a molestation victim.

Jackson was acquitted of the child molestation charges last year. Many jurors said a lack of credibility on the part of the
woman and her children on the witness stand were major factors in their verdicts.

During the trial in Santa Maria, she invoked Fifth Amendment protection against self-incrimination on the welfare fraud issue and did not testify about it.

  • Fraud trial set for Jackson accuser's mom

By LINDA DEUTSCH, AP Special Correspondent
    2 hours, 50 minutes ago

LOS ANGELES - The woman who claimed Michael Jackson molested her son, leading to the sensational trial a year ago at which the singer was acquitted, was ordered Wednesday to stand trial on a charge of welfare fraud.

The attorney for the 37-year-old woman, whose name by marriage is Janet Jackson, entered a not guilty plea on her behalf. She did not speak during the arraignment.

She is accused of one charge related to accepting $8,000 in fraudulently obtained assistance and four charges of committing perjury on welfare applications.

Prosecutors say she hid the fact that she received a substantial settlement in a lawsuit against J.C. Penney before she filed for welfare.

Her lawyer, Patricia Hattersley, said outside court that she hopes the case can be resolved without a trial.

"We are open to discussions," Hattersley said. "Her position is she never misrepresented anything intentionally."

The prosecutor's office said the case will go to trial unless she makes restitution.

The trial is scheduled for Aug. 7. However, the trial date could be postponed to within 30 days of that date, Superior Court Judge Barbara Johnson said.

During Michael Jackson's trial last year, the woman invoked Fifth Amendment protection against self-incrimination and refused to testify about the welfare questions.

The singer was acquitted of the child molestation charges last year. Many jurors said a lack of credibility on the part of the woman and her children were major factors in the verdicts. The defense portrayed her as a con artist who schemed to get money from celebrities and through fraudulent legal claims.

The Associated Press has withheld the identities of the accuser and his siblings, who have a last name different from their mother's.

Mom of Michael Jackson accuser admits welfare fraud

    (2006-11-13)

LOS ANGELES (Reuters) - A Los Angeles woman whose son accused pop star Michael Jackson of sexual abuse last year in a sensational trial pleaded no contest to welfare fraud on Monday and has agreed to repay more than $8,600.

Los Angeles Superior Court Judge Barbara Johnson also ordered the 38-year-old woman, who has not been named by most news organizations to protect the identity of her son, to perform 150 hours of community service.

Johnson said the welfare fraud charge would be reduced to a misdemeanor on April 27 if the woman performs the community service and pays the restitution by that date. The woman was expected to move to Georgia later this year and was ordered by the judge to enroll in a community service program there.

In California, pleading no contest plea is the legal equivalent of pleading guilty.

At the trial last year, prosecutors charged Jackson with molesting the teen and conspiring to hold him and his family against their will at his famed Neverland Valley Ranch in central California. The jury acquitted the entertainer of all charges in June of 2005.

The woman took the witness stand during the trial, testifying that for a time she was forbidden to leave the ranch and was intimidated by Jackson's associates.

She refused to testify about the welfare assistance, citing her Fifth Amendment protections against self-incrimination, and jurors said after the trial that her credibility in court factored into their deliberations.

Jackson, 47, has since moved out of the country, and Neverland remains largely shuttered.
