  • Buchhalter von Beatles und Stones: Allen Klein ist tot
Von Michael Pilz 7. Juli 2009, 04:00 Uhr

Yoko Ono zickte. Michael Jackson zahlte 47,5 Millionen Dollar für die Rechte.

Neun Tage nach Michael Jackson starb auch Allen Klein. Am 4. Juli, in New York, an Alzheimer.

Darin: "Was muss ich tun?" Klein: "Nichts."

Man antwortete: Einen Haufen Geld.

Well I will refer you to the well researched "Northern Songs: The True Story of the "Beatles" Songwriting Empire (Hardcover) by Brian Southall that was first released in hardback in 2006; but then updated in paperback in 2008 on the back of the award winning Radio 2 documentary on the same subject "Only A Northern Song" first broadcasted in 2007; and then updated in 2008 and re-broadcasted.

That in 2006 as part of the refinance deal struck with Sony Corp whereby Michael Jackson received a much needed $300 million; Michael Jackson would retain 50% of the publishing until his death when his estate would retain 25% and Sony Corp would then own 75% of Northern Songs.

As far as I am aware Michael Jackson is dead.

Indeed it is one of those ridiculous media conspiracy theory nonsense that he was killed off so Sony Corp would gain the extra 25% stake.

Still what do I know, I only have the 2008 Paperback edition of the above book (as I'm a bit of a Beatles fan who happens to be employed in the financial sector these sort of things interest me).

The author Brian Southall and his co-author, Rupert Perry, are both true record industry insiders - with decades of experience as executives at EMI and other record companies - and are well-qualified to tell this story. But unlike so many other books by Beatles "insiders", they do not attempt to interject their own personal opinions or views, relying on the the first-hand accounts of the many lawyers, publishers, songwriters, and others involved in the many negotiations and business dealings. And this is what makes their effort so admirable - and so much easier to read. Even if it is a rather dry read as it is factual not subjective.

    My points still stand.

    1. The four Beatles (estates) own Apple Records. Therefore they make a huge profit from EMI records after EMI & Apple have negotiated and agreed on the costs to be attributed to Apple against those Record sales royalties. (It is one of the reasons why you rarely see Beatles albums going cheap for less than £7 in HMV, let alone for £2.99 like you used to see for many Michael Jackson albums before his untimely death).

    2. As songwriters Paul McCartney & Lennon estates each earn 25% of all publishing from songwriting royalties for their Northern Songs. The same as Michael Jackson, which after his death is now down to just 12.5% compared to the 37.5% that Sony Corp will now get from the 2009 The Beatles Remasters.

So (in overly simplistic terms) Michael Jackson's estate will only benefit 6.25% of all profits made from the Beatles Remaster sales. Sony Corp will benefit 18.75%. The songwriters (mainly Lennon/McCartney) will benefit 25% in addition to the remaining 50% split between the artist (The Beatles) and the Record Company (Apple = The Beatles Estates).

Hence, as the A Hard Day's Night 2009 Remasters album entirely consists of 100% Lennon/McCartney Northern Songs compositions (so the quarterly splits between Record Company, Artist, Songwriting & Publishing are easiest to work out) then the profits would be split :

25% John Lennon estate (6.25% Record Company, 6.25% Artist, 12.5% Songwriting)

25% Paul McCartney (6.25% Record Company, 6.25% Artist, 12.5% Songwriting)

12.5% George Harrison estate (6.25% Record Company, 6.25% Artist)

12.5% Ringo Starr (6.25% Record Company, 6.25% Artist)

    18.75% Sony Corp (18.75% Publishing)

6.25% Michael Jackson estate (6.25% Publishing)

  • Ein paar Beiträge weiter steht aber:

    Zitat von bobmoo79

Alas the book you are referring to is wrong. Michael Jackson IS dead, BUT Michael Jackson's estate still retains it's whole 50% stake in the Sony/ATV catalogue and is not required by any agreement to hand over any of it to Sony at this time.

Sony executives and lawyers for MJ’s estate have said they see no changes afoot, but the structure of the partnership would be altered if the estate put its stake on the block. Sony would have first-refusal rights if that happens, and company executives have said they would be interested in increasing their holdings. However, the estate's executors have stated that they are retaining the 50% share in the catalogue as it is worth far more to the children in the long term than it would be if they sold it to Sony now.

  • SONY/ATV MUSIC PUBLISHING #1 IN U.S. MARKET SHARE

Taylor Swift, Lady Gaga and Colbie Caillat Drive Top Billboard Ranking with 20.5% of Fourth Quarter Airplay

(New York, NY) Feb. 24, 2010 – Sony/ATV Music Publishing has captured the No. 1 spot in Billboard's latest ranking of U.S. market share, controlling 20.5 percent of the 100 most popular songs played on the radio.

In the magazine's survey of the three months ending Dec. 31, 2009, compiled from Nielsen data, the company had three of the top 10 songwriters, Taylor Swift, Lady Gaga and Rob Fusari. It controlled 35 of the top 100 airplay songs, including No. 1 track "Whatcha Say" by Jason Derulo. The fourth quarter numbers increased more than three percentage points from the previous quarter and were more than four percentage points higher than the company's share in the fourth quarter of 2008.

"This is a spectacular achievement for our company, especially when you take into account that Sony/ATV is by far the smallest music publishing company of the four majors, and we were ranked fifth just three years ago," said Martin Bandier, Chairman and Chief Executive Officer of Sony/ATV. "Our entire U.S. creative team contributed to this terrific accomplishment, led by an unparalleled roster of talent, producers and writers."

Along with writer-performers such as Lady Gaga, Swift and Colbie Caillat, Sony/ATV songwriters and producers represented in the Top 100 included RedOne, Fusari, Orange Factory and JR Rotem. The company also shared in the success of the No. 8 song in the quarter, "Party in the U.S.A." by Miley Cyrus.

  • "MiJac" Katalog wechselt zu Sony/ATV Publishing
    17.02.11 - 06:33

Ray Charles, Curtis Mayfield und Sly and the Family Stone.

    Zitat

Talks with Sony, which operates the third label, Sony Music Entertainment and Sony / ATV, the music publishing company jointly run with the estate of the late singer Michael Jackson, are said to not be as far along towards reaching a deal.
