Judge denies request by doctor convicted in Michael Jackson's death for new testing on vial

LOS ANGELES (AP) -- A judge has denied a request to retest a vial of the powerful anesthetic that killed Michael Jackson.

Dr. Conrad Murray's lawyer asked for testing on a vial of the anesthetic propofol on Friday.

Superior Court Judge Michael Pastor says Murray's defense attorneys knew about the vial at the start of the case and could have requested the testing months ago.

Attorney J. Michael Flanagan wrote in a court filing that the testing is necessary to analyze the prosecution theory that Murray placed Jackson on an IV drip
of propofol and the painkiller lidocaine then left the room.

A prosecutor argued Monday that Murray received a fair trial and there was no legal basis for the request.

Just days before sentencing, lawyers for the doctor convicted of causing Michael Jackson's death want a judge to order independent testing of a vial of the powerful anesthetic that killed the singer.

Attorneys for Dr. Conrad Murray will ask a judge at a hearing Monday to release to an independent lab the vial of propofol that authorities contend was used on the morning of Jackson's death.

Attorney J. Michael Flanagan wrote in a court filing that the testing is necessary to analyze the prosecution theory that Murray placed Jackson on an IV drip of propofol and the painkiller lidocaine then left the room.

Prosecution expert Dr. Steven Shafer testified during the six-week trial of Murray that the only plausible scenario to explain Jackson's death was that the doctor left the pop superstar on the IV drip.

Shafer said he ruled out all other scenarios, including the defense theory that Jackson somehow gave himself the fatal dose of the anesthetic being used as a sleep aid.

The chemical makeup of the propofol vial "has become relevant to confirm or negate the accuracy of Dr. Shafer's proposed scenario," Flanagan wrote.

Publicists for Murray and his lawyers say the results may form the basis of an appeal of the Houston-based cardiologist's conviction.

Prosecutors and Flanagan were expected to argue about the request during an 11 a.m. hearing.

Murray was convicted two weeks ago of involuntary manslaughter. He remains jailed while awaiting sentencing on Nov. 29
and faces a possible sentence ranging from probation to up to four years.

Gott sei Dank wird das auch live übertragen. Darauf freue ich mich tierisch :grgrins. Mehr noch als auf den Prozeß. Ich hoffe daß bei Verkündung alle Kameras diese blöde Fresse in Großaufnahme zeigen, damit ich sehe, wie er stirbt wenn der Richter ihn für 4 Jahre (bitte Judge Pastor) in den Bau schickt :knast:knast:knast:knast.

Ich bin mächtig gespannt auf diesen Tag. Murray soll bitte, bitte für 4 Jahre in den Bau und danach kann ihn von mir aus der Blitz beim sch****** treffen (t`schuldigung), aber mir würden noch ein paar "nette" Dinge für den Doc einfallen.

so wie die angehörigen sprechen dürfen, über ihren verlust,
so darf natürlich auch der angeklagte noch seinen standpunkt vertreten...
wie man nun liest, hat murray genau das angeblich auch vor.
wenn das so kommt, werden wir uns schonmal vorab auf eine schmutzige,
verlogene, reißerische mitleiderregen wollende tränenreiche nummer von dieser ratte vorbereiten müssen.

rechnen wir am besten mit dem schlimmsten, damit wir am dienstag nicht das kotzen bekommen

Conrad Murray Tells Lawyers: I Want to Speak at My Sentencing Hearing

RadarOnline) - Dr. Conrad Murray has told his lawyers that he wants to formally address the court and Los Angeles Judge Michael Pastor at his upcoming
sentencing hearing in the Michael Jackson death case, RadarOnline.com is exclusively reporting.
Murray was convicted of involuntary manslaughter in the King of Pop’s shocking death and is currently behind bars pending the hearing slated for Tuesday, November 29.

The doctor — who has had his medical license in California yanked — has told his legal team that he will be speaking at the sentencing hearing.

“Dr. Murray wanted to testify, and feels that if he had, there is no way he would have been convicted. Murray is livid that his lawyers didn’t put him on the stand
and has said he plans on pleading with Judge Michael Pastor for mercy. Murray will admit no guilt, and not take any responsibility for his actions.
Murray plans on appealing and wants the judge to give him probation only for killing Michael Jackson,” a source close to the situation says.

As RadarOnline.com previously reported, Murray’s decision to participate in a documentary about the trial could be used at his sentencing hearing.

The convicted felon sat down with the Today Show before being found guilty of killing Jackson on June 25, 2009

“I don’t feel guilty, because I did not do anything wrong, I am very, very sorry for the loss of Michael… Michael is a personal friend. It’s heartfelt.
It’s been painful,” Murray told Today‘s Savannah Guthrie.

Murray’s interview with Guthrie and a British reporter, as well as the documentary, which aired in the U.S. on MSNBC, could be played by the District Attorney during the proceedings.

It’s expected that several Jackson family members will make victim impact statements at the hearing, and Michael’s children could write letters to the judge
that could be read aloud in court by the Jacksons.
Murray could be sentenced to four years in state prison.

er hat nichts falsch gemacht, fühlt sich in keiner weise schuldig...
ja, das haben wir bereits beim prozess gesehn, dass du meinst, du hättest damit nichts zu tun, du penner.
aber mike ist tot, und DU hast ihn behandelt, DU hast literweise das gift besorgt,
DU hasts in seine adern gepumpt, und DU hattest die aufsichtspflicht, du ar***loch!!!

jedenfalls, wenn da mehrere der familie etwas sagen wollen, und der misthaufen auch,
dann wird das ne hyper-emotionale kiste...auch für uns. wir sollten uns echt innerlich drauf vorbereiten

und wenn walgren ( ;D) diese drecksdoku heranziehn sollte...dann könnte das für murray allerdings der endgültige schubs in die knastzelle werden.
dass pastor das nicht besonders gefiel, ist ja ein offenes geheimnis...

Dieses "Etwas" ist so unglaublich in seiner selbstgefälligen Art, daß ich schon gar keine Worte mehr finde :grr.

Judge Pastor hat für meine Begriffe bis jetzt einen guten Job gemacht und ich setze darauf, daß er sich auch jetzt auf das besinnt, was im Prozeß vorgetragen wurde und was er ja in seiner Entscheidung, dieses "Etwas" bis zur Verkündung des Strafmaßes in den Bau zu schicken, zum Ausdruck gebracht hat - nämlich "ein Mensch ist gestorben durch grob fahrlässiges Verschulden eines Anderen".

Ich kann mir nicht vorstellen, daß er sich vom Geheule dieses "Etwas" einlullen läßt. Außerdem ist er mit Sicherheit auch von der ausgestrahlten Doku angefressen. Und ich glaube auch, daß der Vortrag der Angehörigen und vor allem Briefe der Kinder - sollte diese Meldung stimmen - schwerer wiegen.

Cool wäre es, wenn Judge Pastor - bevor Murray sein Gesülz abläßt - Ohrenstöpsel verteilen läßt

oder wenn murray dran wäre, und der richter dann sagt: jetzt wäre ein guter zeitpunkt für eine pause, für alle, die sich das nicht anhören wollen...

D.A. Wants Doc to Pay More than $100 MILLION!!!

Prosecutors in the Conrad Murray manslaughter case are asking Judge Michael Pastor to order the doc to pay Michael Jackson's children more than $100 million for their loss.

According to new court docs filed by the D.A., Michael Jackson's kids are "entitled to wages or profits lost due to injury incurred by the victim."

Prosecutors say MJ's 3 kids are victims under the law, and are entitled to restitution from Dr. Murray ... which include wages, lost profits and funeral expenses. The D.A. cites a letter from the MJ Estate, estimating Michael would have made $100 million in revenue from the "This Is It" tour.

As we first reported, the D.A. is also seeking the maximum punishment -- 4 years in State Prison. The D.A. says they are seeking the max because Murray was "risking Mr. Jackson's life every night" by administering Propofol. And the D.A. says, MJ was a "particularly vulnerable victim." And the D.A. says, Murray lied and covered-up his crime.
