    TMZ has obtained a copy of a legal document that Joe Jackson has sent to Dr. Conrad Murray -- a prerequisite to filing a wrongful death lawsuit ... in which Joe claims Dr. Murray had been drinking at a strip club hours before he allegedly administered a fatal dose of Propofol to Michael Jackson.



    According to the document, "On June 25, 2009, prior to treating Michael Jackson, defendant was at a 'strip club' called 'Sam's Hofbrau' in Los Angeles where he had been 'drinking.'" The doc goes on: "It was reckless for him to 'drink' prior to administering anesthesia to Michael Jackson. He concealed his conduct from Michael Jackson."


    The doc, written by attorney Brian Oxman, outlines Murray's treatment and the medical emergency that ended in Michael Jackson's death.


    According to the document, Michael had "neurological, pulmonary, and anemia signs over several weeks prior to his death. In May and June, 2009, Michael Jackson was confused, easily frightened, unable to remember, obsessive, and disoriented." Oxman goes on: "He had impaired memory, loss of appetite, and absence of energy. He was cold and shivering during the summer rehearsals for his show ..."


    Oxman claims these problems were caused by Dr. Murray administering a "polypharmacy" of drugs (multiple meds) to Michael. And Oxman claims, Dr. Murray "ignored the signs of Michael Jackson's pulmonary inflammation, brain swelling, and anemia."


    Oxman alleges Murray repeatedly lied about the drugs he administered to Jackson and withheld vital information from EMTs and doctors who were trying to save Jackson's life. He repeated all of the alleged inconsistencies that have been previously reported.


    Oxman says of Dr. Murray, "His conduct was inhuman. It was an extreme violation of the standard of care."


    We're told Dr. Murray received a copy of the document in March. Dr. Murray's legal team tells TMZ, "The allegations are absolute, utter nonsense."


    And people close to Dr. Murray insist he does not drink ... ever.


    We're told the document was served on Dr. Murray on March 27, 2010. According to California law, Joe Jackson must wait 90 days from the date the document is delivered before filing an actual wrongful death lawsuit. The 90-day period is up Friday, the anniversary of Michael's death.

    Michael Jackson's father was "grievously wronged" by a probate court that decided last year not to let him try to replace the administrators of his son's estate, an attorney has argued.
    The arguments by attorney Brian Oxman were heard by a three-judge panel of the California Second District Court of Appeal after a probate judge ruled last November that Joe Jackson did not have standing to intervene in the matter.


    The appeals panel did not issue a ruling but did question the legal steps Joe Jackson had taken after being left out of his son's will and whether the moves warranted revisiting the challenge to the administrators.


    Associate Justice Laurie D Zelon asked why Joe Jackson had withdrawn a petition to receive a monthly stipend from the estate before the probate court had a chance to rule on the request.


    Zelon also noted that Oxman, who represents Joe Jackson, hadn't told the probate court about a wrongful death lawsuit being considered by his client.


    "I must beg this court's forgiveness. I must beg the probate court's forgiveness - the magic words 'wrongful death' did not pass my lips," Oxman said.


    Associate Justice Fred Woods also questioned why Joe Jackson hadn't filed a creditor's claim with the estate, since he has claimed his son supported him financially throughout his life. Oxman said there was never a contract between Michael Jackson and his father for assistance.


    Attorneys for Jackson's estate reminded the appeals panel that the singer had omitted his father from his will and he was not considered a beneficiary of the estate.


    "He is not an heir," estate attorney Howard Weitzman told the panel in brief remarks.


    Attorneys for the singer's mother, Katherine Jackson, and his three children also argued against Joe Jackson's petition. Michael Jackson's will appointed attorney John Branca and music executive and family friend John McClain to oversee the pop singer's estate.

    Diese ganzen Symptome, wie das verringerte Erinnerungsvermögen etc., deuten sehr
    stark auf irgendwelche neurologisch wirkenden Medikamente hin.
    Dieser Metzger ist einfach nur ein Schwein!!! Wie konnte er nur die Alarmsignale
    Michaels Körpers missachten?! Wie konnte es überhaupt zu diesen Symptomen kommen?!
    Nein, auch 16 Monate nach Michaels Tod kann ich es einfach nicht wahrhaben,
    was da für eine riesen Scheiße da abgezogen wurde.
    Ich kann einfach nicht begreifen, warum das auch kein anderer, wie Ortega die
    Tänzer, Musiker, Bodyguards, bemerkt haben. Warum hat keiner geholfen!? Warum konnte
    keiner einschreiten!?
    Niemals werde ich das begreifen. Und was war mit Michaels Köchin!? Haben die

    Jetzt erzählte Joe Jackson, warum er die Klage gegen Dr Murray einreichte und mindestens zehn Millionen Dollar will. Der 81-Jährige will das Geld als Schmerzensgeld angesehen wissen. Laut "tmz.com" sagte Joe Jackson jetzt, er habe Murray verklagt, weil er ihm seelische Wunden zugefügt habe. Immerhin sei der Arzt für den Tod seines "geliebten Sohnes" Michael Jackson verantwortlich.     Court rejects Michael Jackson father's appeal


    LOS ANGELES – A California appeals court rejected a bid Tuesday by Michael Jackson's father to challenge the administration of his son's lucrative estate.


    A three-justice panel of the California Second District Court of Appeal unanimously affirmed a probate judge's ruling that Joe Jackson didn't have standing to intervene in his son's estate.


    A copy of the opinion was not immediately available.


    Despite being excluded from his son's 2002 will, Joe Jackson had been seeking to have some control over financial affairs.


    Estate attorney Howard Weitzman said he was pleased the court affirmed the pop star's wishes to make John Branca and John McClain executors of his will.


    "We hope this decision finally puts this issue to rest," Weitzman said.


    Brian Oxman, Joe Jackson's attorney, said the father should have some say in post-death affairs involving his son.


    "This is not right," Oxman said of Tuesday's ruling.


    The appeals court heard arguments in the estate case on Oct. 6. The panel questioned several steps taken by Joe Jackson in the case, including withdrawing his request for a monthly stipend.


    The panel also questioned why Oxman didn't mention during a lengthy hearing in November that he might file a wrongful death lawsuit. Last June, Joe Jackson sued Dr. Conrad Murray, the physician charged with involuntary manslaughter in Michael Jackson's death.


    Michael Jackson's estate has earned tens of millions of dollars since the singer's death in June 2009 at age 50 in Los Angeles.

    The "Thriller" hitmaker died in June, 2009 and his estate has since amassed a $275 million fortune.
