  • AEG Wants Katherine Jackson Lawsuit Dismissed

Updated: Thursday, 30 Dec 2010, 5:32 PM PST
    Published : Thursday, 30 Dec 2010, 5:32 PM PST

Los Angeles - A lawsuit brought on behalf of Michael Jackson's mother and children against the promoters of the concert tour he was poised to begin at the time of his 2009 death should be dismissed, lawyers for AEG Live argued in court papers filed today .

The suit was filed in Los Angeles Superior Court on Sept. 15 on behalf of Katherine Jackson and her son's three children, Michael Jr., Paris-Michael Katherine and Prince Michael, also is known as Blanket.

The suit alleges AEG Live is responsible for the medical decisions made by Dr. Conrad Murray, the singer's personal physician at the time, who has pleaded not guilty to involuntary manslaughter in Jackson's death.

The suit alleges breach of contract, fraud, negligence, negligent infliction of emotional distress and employer responsibility.

In newly filed court papers, AEG Live attorneys maintain the Jackson family matriarch and her grandchildren "lack standing to bring these claims other than as wrongful death theories" because the complaint, in effect, asserts claims on behalf of the late singer.

The AEG papers also state that Jackson "controlled his own medical care and hired his own longtime personal physician." The company "did not choose or hire Dr. Murray, it merely conducted negotiations named at retaining him as an independent contractor on the tour."

AEG's legal team wrote that Jackson "was not helpless or incompetent; he lived in his own home, negotiated his own contracts, engaged his own attorneys and cared for his own family."

The AEG papers further state that the lawsuit "gets one thing right: Michael Jackson's death on June 25, 2009, was a tragic event. It was tragic for his children. It was tragic for his fans. Otherwise, however, the complaint gets both the law and the facts entirely wrong."

AEG "labored tirelessly to make a reality of Michael Jackson's dream of a triumphant return to the world's stage" in a series of sold-out London shows, the defense court papers say.

The suit portrays the singer as being "confused, easily frightened, unable to remember, obsessive and disoriented" in the months before his June 2009 death at age 50 in Los Angeles.

"He was cold and shivering during the summer rehearsals for his show, and as shown in photographs of him, he uncharacteristically wore heavy clothing during the rehearsals, while other dancers wore scant clothing and were perspiring from the heat," the suit states.

Rather than cut back on the rehearsal schedule so that Jackson could recuperate, AEG "insisted that he attend every rehearsal in a grueling schedule, threatening that if he missed even one more they would cancel the tour ...," his mother alleges.

She claims AEG, "so that it could reap staggering profits from the tour," instructed Jackson to stop taking medication and that he be treated only by Murray.

Jackson's eldest son "witnessed his father suffering and accordingly has suffered great trauma and severe emotional distress," the suit says. But according to AEG's response, the Jackson family lawyers do not allege the boy was present when Murray gave propofol to the singer, nor do they claim Michael Jr. was aware the physician was causing any harm to his father.

The AEG court papers also state it was unforeseeable that Murray, "a licensed physician with no history of malpractice," would administer propofol in the entertainer's home "and that Michael Jackson would die as a result..."

  • It's WAR at the Michael Jackson House

Michael Jackson's estate is asking a judge to do what Katherine Jackson can't -- kick Alejandra Jackson and her kids out of the Hayvenhurst estate for good.

TMZ has obtained legal docs in which the estate is asking the judge to remove Alejandra, Jaafar, Jermajesty, Genevieve, Donte and Randy Jr. from the estate ... on grounds they're not beneficiaries of Michael Jackson's will and have no claim to the property.

As TMZ first reported in November, Katherine Jackson told Alejandra and the kids -- fathered by both Jermaine and Randy -- not to return to the residence. Alejandra is refusing to move herself, her kids, and her stuff out ... so the estate has gone to court.

As TMZ also previously reported, the house is scheduled to be renovated -- but sources tell us Alejandra is holding the remodel hostage by refusing to leave.

    Krieg im Hause JACKSON!

Es herrscht Krieg im Hause Jackson... Warum?

  • Tell-All Book At the Root Of Jackson Family War

8 minutes ago by TMZ Staff

Katherine Jackson's war with Jermaine/Randy's baby mama Alejandra Jackson is all about a tell-all Alejandra is working on ... sources directly connected with the family and the dispute tell TMZ.

We broke the story ... the Michael Jackson Estate has filed legal papers trying to evict Alejandra and her kids, Jaafar, Jermajesty, Donte, Randy Jr. and Genevieve from the family home in Encino, which was owned by MJ and now the Estate.

Now TMZ knows what has lead to this legal showdown.

Katherine and her lawyers asked Alejandra and her kids to leave months ago, following the stun gun incident with Jaffar. Alejandra lawyered up, and the Estate put an offer on the table -- the Estate would give her a condo, but in return she'd have to sign a confidentiality agreement and promise, among other things, not to write a tell-all book.

We've learned Alejandra refused to sign a confidentiality agreement and is in "active negotiations" for a tell-all.

When Alejandra was in Japan last month with her kids, everyone assumed she was going away for good and Katherine temporarily moved out to remodel the house.

But Alejandra came back, moved back in, refused to leave, stalling the remodel.

Sources say Katherine's lawyers called the cops last week to forcibly evict Alejandra, but the police said they couldn't do anything without an eviction order ... which is why the Estate is going to court.

:rofl

  • :never Oh je, oh je.

Michaels Nachlass!

  • 'This Is It' Producer: I Didn't Cause Michael's Death

1/7/2011 4:50 PM PST by TMZ Staff

The producer/director of Michael Jackson's "This Is It" tour is scoffing at Katherine Jackson's wrongful death suit in which he's named as a defendant, because he had nothing to do with the drugs or treatment that caused the singer's death.

Kenny Ortega just filed legal docs -- obtained by TMZ -- asking the court to remove him as a defendant in Katherine's suit, claiming, "Kenneth Ortega is not alleged to be involved in the medical treatment or administration of drugs that allegedly caused Michael Jackson's death."

Ortega's lawyer adds ... Kenny never had a contract with Dr. Conrad Murray or with Michael Jackson, nor has he had any official affiliation with AEG.

Ortega's lawyer says, "The naming of Kenneth Ortega as a defendant in this action, without any basis, without any substantive charging allegations against him, is a gross error."
