Financial Accusation Riles Jackson
In a taped deposition, the pop star says he didn't take money from the former associate who is suing him for unpaid fees and loans.
By Tanya Caldwell, Times Staff Writer
July 8, 2006In a videotaped deposition played for a Santa Monica jury Friday, pop star Michael Jackson said he was insulted by the accusation he would take money from a business associate to go on shopping sprees or buy jewelry for Elizabeth Taylor.
"I work for what I get," Jackson told lawyer Howard King during the video, which was projected onto a screen in the courtroom.
"Don't make like I'm begging from anybody. I have pride."
Most of the nearly four-hour video, which jurors began watching Thursday afternoon and finished Friday, concerned Jackson's failure to remember his own financial transactions. After the viewing, King, who represents former Jackson associate F. Marc Schaffel, made brief remarks to the jury and then rested his case.
Schaffel, a former pornographer, sued Jackson, claiming the singer owes him $1.6 million in unpaid fees and loans for shopping trips, work on a charity record and production of two Fox TV videos aimed at countering a documentary that led to child molestation charges against the star. Jackson was acquitted last year. Jackson, who has left the United States, will not testify in person.
He has countersued Schaffel, claiming that the filmmaker stole money during a charity event, as well as artwork. Jackson said he fired Schaffel in 2001 after learning of his past as an adult film producer.
In the video, Jackson said he couldn't remember borrowing cash from Schaffel, including $375,000 for shopping in May 2003.
"It sounds spoiled, but it doesn't sound like me," Jackson told King in the video.
"You're not a big shopper?" King asked him.
"Not like that. No," Jackson said.
If Schaffel got him money, it came from his own account, Jackson said.
"I would never ask him for his money. That's ridiculous," Jackson said. "I would never."
Jackson also said that he had some knowledge of Schaffel's thefts, "but not in detail."
Jackson's lawyers began their own case by presenting a deposition from a property manager supporting the entertainer's claim that most of his cash came from leasing his Neverland Ranch for cattle grazing.
The trial is scheduled to resume Monday. Superior Court Judge Jacqueline A. Connor told jurors she expected closing arguments either Tuesday or Wednesday.

Jackson tells his side by video in suit over alleged debt
By LINDA DEUTSCH The Associated PressSANTA MONICA, Calif. — In videotaped testimony shown to a jury Friday, Michael Jackson professed little memory of major financial transactions involving a former associate who claims the pop star owes him about $1.8 million Cdn.
Jackson, who was interviewed twice in London by F. Marc Schaffel’s lawyer, said he did remember at least one occasion when Schaffel delivered money to him on the set of a music video.
He said it arrived in a fast food bag and they called it "french fries," which became their slang for money.
But Jackson said he thought any money Schaffel gave him came from Jackson’s own funds.
"I would never ask him for his money," Jackson responded. "That’s ridiculous. I would never."
Schaffel’s lawsuit originally claimed Jackson owed him $4.2 million Cdn for unpaid loans, royalties and other debts, but he has reduced the claim to $1.8 million Cdn.
Jackson’s videotaped deposition was shown to the jury because the singer will not appear at the trial.
Jackson said he remembers Schaffel working on the production of his ill-fated charity record What More Can I Give, but didn’t expect to pay him, thinking that his efforts were a charitable donation.
When he found out in late 2001 that Schaffel had a background in producing gay adult movies, Jackson said, he decided to fire Schaffel but didn’t do it personally because he didn’t want to embarrass him.
Asked how Schaffel wound up back in his employment in 2003 when he produced two TV specials that aired on Fox, Jackson said, "I didn’t directly rehire Marc Schaffel. It was somebody in the organization who obviously did."
Jackson also said he couldn’t remember giving Schaffel instructions for such chores as paying Marlon Brando $1.1 million to appear at Madison Square Garden for a show Jackson was doing in September 2001.
"Did you want to pay Marlon Brando ($1.1 million) for appearing at your Madison Square Garden concert?" lawyer Howard King asked.
"It wasn’t so much for the appearance as it was for the fact that he said he really needed it and I wanted to help a friend," Jackson said.
When King pressed Jackson about whether Schaffel once loaned him $1.1 million, Jackson again cited a lack of memory but suggested he would not have taken such an amount if it wasn’t his.
"Nobody just gives me money," he said. "That’s not right and I work for what I get. Don’t make like I’m begging from anybody. I have pride."
Jackson also laughed at one point when King suggested that Schaffel had given him $420,000 to go shopping.
"It sounds spoiled, but it doesn’t sound like me," Jackson said. "Give me ($420,000) to go shopping? That’s not me. I am sorry."
King followed up with a question: "You’re not a big shopper?"
"Not like that, no," Jackson said.

Listen to all the voice mail messages that were played in court on Wednesday here...
thanks Midas at KOP
They confirm several things
1. Proof that the VM on GMA was doctored. The actual VM prooves MiJac was asking for 7Million not from
Schaffel/Deiter as they had suggested but from JIVE as an advance to the work he was doing.
2. Michael was is very passionate and was pushing to get the charity single released, he clearly is
disappointed Schaffel was not doing his job. Michael knew exactly what he wanted, how he wanted it done,
Marc didn't do the job-----------------------

Hi there,
Here you'll find interesting Phone Calls from Michael to Marc Schaffel.
I think people can misinterpret this on the other hand this cleary shows that Marc Schaffel and Co. treated Michael very bad and were out to get money from him, it's really sad, especially because I've warned Michaels Management about this at that time...

I don't understand how the dates on the recording can be real. It would mean that this was recorded in 2003. But Michael was all ready working on the demo of "What More Can I Give" in September of 2001. Michael mentions the Bambi awards which was on November 21, 2002. Michael talks about putting the film together.. Well he released the "What More Can I Give" video AT the Bambi awards.. so by the time this was suposedly recorded, Michael all ready had the video recorded, publically viewed at Bambi awards.. But he talks about buiding the video and making of, AND he talks about the fact that it has all ready been played at Bambi awards.. It seems to be sliced up, either Timeline over the same some was all messed up, or there was another song that the title is cut out and replaced with WMCIG...
OK lets just say Michael was more talking about the VMA version of WMCIG and th re-release of the project... OK well "4 months' after the recordings was the VMA's on October 27, 2003. But by that time we all ready knew that Sony refused to release it as a single. OK now pay close attention to this...IN 2002 BETWEEN June 13th and June 15th Michael held several demonstrations in London against SONY for not doing what they should for Invincible AND refusing to release WHAT MORE CAN I GIVE.. SOny stated that they refuse to release it because it would be embarresing to have MARK be a part of it due to his Pornography past..
* In the recording Mike said he needs Sony on this project. (does not add up)
* Michael knew it was not going to be released (Why do projects, and how can it be at #1 for two months)
* What More Can I Give was said to be a song for victomes of 9/11 (He said it himself)
* He began working on it in September or 01' RIGHT after 9/11 (What does Iraq have to do with 9/11)Michael has been talking about LEAVING SONY since BEFORE the recordings. He knew that it would never be released because he was in contract with SOny and they refused to release it. Why would he try so hard with the MAKING OF, and all that stuff in 2003 over a YEAR after SOny refuses the releasal. and Michael publicaly states that he plans to leave SOny... I believe that there was another song that Michael worked on after the war in Iraq began that was never publically known or talked about.. And recordings of that was sliced with recordings about WMCIG.. Don't forget this guy is a videographer.. Which means he knows about editing.. Audio has very simular styles when it comes to that..

Marc, I really need to you get from Jive [Jive Records] seven million dollars for me as soon as possible. I agreed to do this thing, but there's something here that I really wanna get. You can do this for me. I know the deal is bigger than seven, but I just want seven up front. If you can get that for me it would be, you know, perfect. Seven, seven-and-a-half. As an advance. Can you please try to get that for me? There's something here I really want. Thanks, bye.MESSAGE: Received June 22nd at 5:42AM
Number one, your breath stinks -- I'm just kidding. Marc, it's very important that, Al is coming in this week, he's coming Monday for a meeting. We want to show him the short film of 'What More Can I Give' - the one that you guys did in Germany for the Bambi Awards. We want to show that one with the song. It should be America For Iraq. Because America is trying to heal Iraq after they did their you know, genocide, I shouldn't say that, but, you know, we should do this. Every star is on it, it's done, it's packaged and it's ready to go. And, no company can pull out because they will be shamed by the press saying, 'how dare you not contribute and help!' So, they all have to do this, and there will be a special behind it, we can do 'The Making of', we can do all kinds of quotes from the different entertainers, how the thing was put together, you know? And, it's time to do it. This is the perfect cause, it's about 'What More Can I Give?' We're giving. It's about healing. We want to heal now. It's worth more now than for any of the other causes. So, make sure that they see this thing. Make sure. Okay? Let's set it up so they can see it on a big screen. You know, one of those projection-type of things. And, call me, tomorrow! You must call me, Marc! You gotta find me. We gotta - it has to come out! It has to come out, okay? Call me marc, or I'll be really disappointed. You gotta do this. Thank you.MESSAGE: Received June 23rd at 2:05AM
Marc, call Al first thing in the morning by my orders. You tell him, the single has to come out now, 'What More Can I Give.' They are planning other anthems, we have to be first. And, I want Sony - they gotta go to Sony and get them geared up. It has to get to that number one and stay there for like, uh, to make a record we want to have it like two months. Because people want to do something, they feel sympathy, USA For Iraq. It's a beautiful thing to do. Okay? We gotta do this, Marc! It's important. You went through all that work. I went through all that work of writing the songs. You were-- Frank [was] putting the film together, I'm putting the film together. You know? You gotta send me, Marc, all of the outtakes. 'Cause I'm not approving it. I'm not gonna let it come out unless I see all the outtakes. Don't be holding anything back at your house, I want to see everything. Okay? Get on this first thing in the morning. It's important! Thank you.Quellen: MJJF, Malibu

Jackson: He Tried To Adopt Brazilian Babies
Michael Jackson tried to adopt two babies in Brazil in 2002-2003. At first he wanted two boys, then a boy and a girl. “He couldn’t make up his mind,” says a source. “He was also looking at three-year-olds and four-year-olds.”
A taped phone message not yet played in court is said to reveal Jackson telling an associate: “Get me two boys, no, get me a girl and a boy.” Says one source, “It sounds like someone asking you to run down to the store and get ice cream.”
Jackson used former associate Marc Schaffel—who’s now suing him in Santa Monica for $3.8 million—to set up the transactions. Contrary to Jackson’s story that he cut off relations with Schaffel when Jackson was told he was a producer/director of gay pornography, the associate never stopped working for him at all. He just changed his job description.
The $300,000 secret payment that I told you about last week was going to be used for this adoption. When that didn’t work out, the money (already in Brazil) was subsequently used to buy the continued silence of a family Jackson had quietly paid off years earlier when they claimed he’d had inappropriate relations with their son. After Jackson was arrested for child molestation in November 2003, the family in question split for South America to escape being interviewed by Santa Barbara police detectives, then called and asked for additional funds.
What’s happening here is that Jackson’s lawyers, in their zeal to destroy Schaffel’s reputation, are exposing more of Jackson’s secrets. In fact, it may yet come out in court that Jackson knew from the time he met him about Schaffel’s career in gay porno, my sources say. I am told that Jackson was well aware of it long before his lawyers showed him tape of Schaffel directing an adult video. It was also revealed in court last year, during his child molestation trial, that Jackson had in his possession a great deal of gay pornography which he claimed fans sent to him.
The Brazilian adoption scheme came to fruition in 2002, sources says, when Schaffel, hired a Miami immigration lawyer for Jackson. The female attorney, who knew she was working for Jackson, was Brazilian and had roots in the adoption community there. It’s not clear whether Jackson’s current attorneys even know this happened. But Schaffel, having been temporarily sidelined as music producer by Jackson in 2002, was sent on this mission instead.
The search for a willing orphanage and the right children went on through most of 2002, until Jackson, Schaffel, manager Dieter Wiesner and Jackson’s children—including the recently adopted “Blanket”—went to Germany for Jackson to accept a Bambi award. It was there that Jackson infamously dangled Blanket out of a hotel window. Schaffel was in the room next door, debunking the theory that he and Jackson had parted ways months earlier.
Schaffel and Jackson’s plans for the adoption were derailed in early 2003, when Martin Bashir’s documentary aired on television, and the Arvizo family infamously came to stay at Neverland. Schaffel then produced two rebuttal films for Jackson in February 2003 as well as handled the Arvizos' comings and goings. When the family was finally jettisoned by all concerned in March, Schaffel revived the search. But it ended in November 2003 when Jackson was arrested on charges of child molestation and conspiracy. He was acquitted in June 2005.
There’s more to this story, and it only gets worse. The reason all this is coming out, of course, is because the Schaffel v. Jackson trial continues without a settlement. The reason for this can be only one of two things: Jackson is either getting the worst advice ever from lawyers who are also billing him at top dollar, or he simply doesn’t have the cash on hand to settle the case. My guess is it’s both, and before this trial is over, Michael Jackson’s reputation will be even more thoroughly damaged than it was last year.

Closing arguments could come this week in Michael Jackson lawsuit trial - Testimony resumes in the Michael Jackson lawsuit today.
Last week, the plaintiff said Jackson gave him the job of finding boys to adopt, and a Jackson adviser said Jackson may have to pay something to the plaintiff.
Former Jackson associate Marc Schaffel (SHAF'-el) surprised even his own attorney by suddenly claiming Jackson sent him to South America to find boys for adoption. The singer's attorney denounced it as a smear.
Schaffel blurted the allegation as Jackson's lawyer questioned him about having been a gay porn producer
Outside court, Jackson adviser Londell McMillan said while Jackson may have to pay Schaffel something, he'll no longer pay off "outrageous claims" just to avoid a court fight.
McMillan also said restructuring Jackson's finances will enable him to regain his throne as the King of Pop.

Man suing Michael Jackson claims star sought to adopt boys
SANTA MONICA, Calif. -- A former associate suing Michael Jackson for $1.6 million suddenly claimed on the witness stand Friday that he once was dispatched to help the pop star adopt boys in Brazil, but the singer's attorney denounced the story as a smear.
Even the lawyer for former Jackson associate F. Marc Schaffel said he was shocked when Schaffel blurted out the claim while being questioned about his background in the gay pornography business.
"It's not really relevant to this case," Schaffel's attorney Howard King said outside court. "I thought we were not going to go there. We've tried to be upstanding."
Jackson's lawyer, Thomas Mundell, said he had never heard the allegation during all the pretrial investigations.
"It was an effort to smear Mr. Jackson with a remark that could be interpreted to hurt him in light of the case against him last year," Mundell said. Jackson was acquitted of child molestation charges last year in Santa Maria.
Schaffel is seeking $1.6 million from Jackson, down from the $3.8 million his lawsuit originally claimed he was owed for unpaid loans, royalties and other debts.
Schaffel was being questioned about his personal ties in Brazil when he denied that he had been on a trip to recruit talent for gay videos.
"No, I've not used any Latin models," Schaffel said.
Mundell then asked if he had an interest in a company known as Latinboys.
Schaffel bristled and said he did not, then blurted out, "The main purpose of my trip was Mr. Jackson wanted to adopt some boys."
He had testified earlier that Jackson sent him to Brazil in 2001 to deliver $300,000 to a "Mr. X" in Argentina and said he went to Brazil to withdraw the money from a personal account he had there.
But Schaffel never disclosed what the mission was about, and, in a videotaped deposition of Jackson that was played Friday, the pop star denied that he ever sent Schaffel to deliver money to Argentina.
He was asked, "Have you ever asked Mr. Schaffel to make payments to third parties that you didn't want anybody else in the world to know about?"
Jackson answered "No."
"Have you ever asked Mr. Schaffel to pay $300,000 to a family in Buenos Aires?" asked King.
Jackson, appearing taken aback, laughed and said, "No."
Also Friday, the singer's defense questioned entertainment attorney Raul Perez, who represented Schaffel to record companies in the effort to release Jackson's ill-fated charity recording "What More Can I Give."
He said he was in charge of obtaining releases for some 40 artists who participated in the record and a Spanish-language version. But he said Sony, which had to sign off on the release, balked at Schaffel's involvement.
"This was a major record, with every pop star at the time," Perez said. "I don't think Sony was happy that a person no one ever heard of named Marc Schaffel was the producer. ... There was always a sense of how the heck did Michael Jackson put this person in charge of this record?"
He indicated that once it was discovered that Schaffel's background was in pornography, the project was doomed.
Schaffel's suit claims expenses and an ownership interest in the record. But in a video deposition Jackson was adamant that Schaffel had no rights to the record because Jackson wrote the song and it was his creative product.
On the videotape Jackson also professed little memory of major financial transactions involving Schaffel and said he thought any money Schaffel gave him was his own, not Schaffel's.
"I would never ask him for his money," Jackson said. "That's ridiculous. I would never."
He also laughed when King suggested that Schaffel gave him $375,000 to go shopping.
"It sounds spoiled, but it doesn't sound like me," Jackson said. "Give me $300,000 to go shopping? That's not me."

Michael Jackson schickt Gericht Videobotschaft

Michael Jackson Deposition Segment About Schaffel's Past (TMZ)
Here is approximately three minutes of raw deposition footage from when Michael Jackson was questioned by Marc Schaffel's lawyer, Howard King, in regards to the time when Michael first found out about Marc Schaffel's past.

Michael Jackson claims he was blindsided by a business partner who had worked in the world of gay porn.
Jackson is being sued by former gay porn producer Mark Schaffel, who claims the singer owes him nearly $4 million in loans and salary. Schaffel began working with Jackson in 2000 on a charity musical project, even though he had no experience in the world of music.
In a videotaped deposition, Jackson says he became aware of Schaffel's background when a lawyer showed him a videotape of a gay porn flick. "I was shocked by what I saw...(Schaffel) was directing two guys. They were naked from head to toe and he was telling one what to do with the other and he grabbed their penis or something."
Jackson claimed he had no idea of Schaffel's background and felt betrayed.
---Note: Despite what the TMZ article implies, Michael makes it very clear in his deposition that he was not shocked per-say about the video itself, but he was shocked with the fact that Marc Schaffel had never told him what his 'real' business was.

Michael Jackson Deposition
Transcript
May 22, 2006 - 11:56:58AM to 12:01:14PM
King: What is it that you saw that shocked you?
Jackson: Uh, Marc directing this film, and what he did in the film -- what I saw on the screen. I didn't believe it, so. (Shrugs)
King: What did you see on the screen that you didn't believe?
Jackson: Uh, he was directing two guys, they were completely naked from head-to-toe and he was directing -- telling one what to do with the other and he grabbed their penises.
King: And, it shocked you?
Jackson: Well, because I was surprised that he was in that business, which he never told me. And, it was something that was not appropriate you know, for what I was projecting with my work. So, it just didn't match, it's like, you know, you know that.
King: Which part was not appropriate?
Jackson: You know that. Well, it just was inappropriate; I don't think mothers who were watching this sort of thing or know about this relationship-- knowing that we're going to do-- knowing what my agenda is coming up with what material I have coming forth to the world, with songs, with film ideas, it's just, the two won't go together. That's what it is. And in, in myself.
King: So, you use the word pornography, what do you mean by the world pornography?
Jackson: What do I mean by it?
King: Right.
Jackson: That's what it was. 'Cause at first on the screen they were doing one thing, then when he came in he was like directing the whole thing. That's pornography, I think.
King: So you're, you're actually not trying to make a legal definition of pornography. You're just saying that you saw naked men holding each other's penises and that bothered you?
Jackson: Well, I'm just telling you what I saw. I'm just telling you what I saw.
King: Right, but you said you were shocked. I'm trying to figure out what shocked you.
Jackson: Well, I was shocked because he didn't tell me.
King: Had you ever asked him what he did in the past?
Jackson: No, I would think he would tell me. Don't try to make a mess of this, come on.
King: You sued him, Mr. Jackson. (MJ is visibly and audibly annoyed) You never asked Mr. Schaffel what he did--
(MJ tosses pen onto table)
King: Before he met you, for a living. Right, is that your testimony?
Jackson: Umm, he pretty much hid it, I think. He didn't, he didn't tell, he didn't say any of that.
King: No, I just asked you if you ever asked him.
Jackson: If I ever asked him? I could have, but he didn't say.
King: Do you remember asking him what he used to do for a living?
Jackson: He used to talk about stories about his life, but he never talked about, about that.
[FOR REASONS UNKNOWN, TMZ CUT OUT THE NEXT 1 MINUTE 23 SECONDS WORTH OF TESTIMONY]
King: Back to what shocked you in this film. Did it shock you that it was a gay-themed show?
Jackson: No. Uh, what shocked me is that he was involved in that whole circle and I didn't know. It's like you, thinking that you know one person and then there's another something, another character there. I didn't know -- no idea that it was something he was involved with.

Jackson defense in lawsuit targets plaintiff's backdated checks
LINDA DEUTSCH
Associated PressSANTA MONICA, Calif. - In the days after being fired by Michael Jackson, former associate F. Marc Schaffel rushed to issue 18 backdated checks totaling $784,000, the pop star's attorney showed Monday.
Schaffel, who is suing Jackson for $1.6 million, testified in Superior Court that he wrote the checks for items including prepayment of $54,000 in rent on his home, prepayment of utilities and phone bills, and reimbursement for expenses such as camera rentals after he received the termination letter on Nov. 15, 2001.
Showing Schaffel one of the checks, Jackson attorney Thomas Mundell said, "And you dated it Nov. 14 because you knew if you dated it after that you would run into problems because of the termination?"
"Yes," said Schaffel.
Mundell asked, "Isn't it true you falsified books and records to try to get as much money as possible from Mr. Jackson before your termination?"
Schaffel replied, "I just didn't want to get caught holding the bag for expenses Mr. Jackson had agreed to."
He said he and Jackson had an agreement for Jackson to pay his expenses for six months subsequent to the date of termination.
"I wasn't sure with the jockeying that was going on with the advisers that part was going to happen," Schaffel said.
Schaffel also testified that, even after being informed he was being let go, he and Jackson remained friends and talked frequently about projects.
But Mundell produced an e-mail written by Schaffel to the man who introduced him to Jackson, Dr. Arnie Klein, which seemed to contradict that assertion.
The e-mail written on Jan. 30, 2002, said, "I am deeply saddened this has cost my friendship with Michael Jackson. ... I was the only one willing to fight for him all the time. I miss being able to help him. I miss my friend. All our projects have come to a stop."
Much of Monday's testimony consisted of Mundell showing ledgers and checks to Schaffel.
Schaffel continued to interject comments about a claim he made last week that Jackson wanted him to help find children in Brazil to adopt.
Mundell let the comments pass but pressed Schaffel to explain a charge of $300,000 to Jackson for money that Schaffel claimed to have delivered to a "Mr. X" in South America on the pop star's behalf.
"Payment was made from a bank account you had in Brazil?" asked Mundell.
"No," said Schaffel. "I had money in Brazil from an earlier transaction. It wasn't in the bank. It was in a safe."
"It was in a safe in Brazil?" Mundell asked.
"Yes," Schaffel said.
"I see," replied the attorney.
Mundell has previously pointed out that there is no receipt for the $300,000.

Witness: Jackson 'angry, upset' at associate's past in gay porn
LINDA DEUTSCH
Associated PressSANTA MONICA, Calif. - In November 2001, Michael Jackson was oblivious to the fact that the man he hired to produce a charity recording to benefit victims of the Sept. 11 terror attacks had been a producer of gay pornographic movies, the singer's former lawyer testified Monday.
Zia Modabber said he broke the news to Jackson about F. Marc Schaffel's background and met with the pop star in the middle of the night to show him a video of Schaffel directing a gay porn scene.
"Can you describe Mr. Jackson's reaction?" asked Thomas Mundell, who is defending Jackson against Schaffel's claims that the pop star still owes him $1.6 million.
"I think he didn't want to believe it was real or true," said Modabber. "He appeared angry, upset."
Modabber's testimony was elicited as Jackson's side sought to show that Schaffel enriched himself at the singer's expense. Modabber was permitted to testify on limited subjects after invoking attorney-client privilege.
He identified a blizzard of letters that moved between him and Schaffel's lawyer after Schaffel was notified that he was being terminated by Jackson.
"My focus was on doing what I could to get the rights to release the single," Modabber said of the song, "What More Can I Give," which was being held up because Schaffel claimed rights to it.
"I got involved with trying to clean up that mess," said Modabber.
He told how his efforts led to a Japanese company that was negotiating with Schaffel, unbeknownst to Jackson, for the rights to the master recording of the song.
Modabber's letters continually warned that Schaffel "has no rights to exploit, distribute or in any way pledge any interest in the master recording of 'What More Can I Give.'"
But he said that Schaffel went ahead and at one point collected $900,000 from the company, Music Fighters. He said the company essentially received nothing.
In a videotaped depostion shown earlier in the trial, Jackson unequivocally stated that he was the composer of the song and the rights belong to him.
With Modabber still on the witness stand, Schaffel's lawyer, Howard King, attempted to show that Jackson intended for Schaffel to have rights to the record.
Modabber said he was aware that in 2003 Jackson began working on something with Schaffel again, and he protested, saying, "We should not be doing business with Mr. Schaffel."
Asked how Jackson's people responded, the witness said, "I was told they were handling it."
Earlier, Jackson's attorney questioned Schaffel about his rush to issue 18 backdated checks totaling $784,000 in the days after being fired by the pop star.
Schaffel said he wrote the checks for items including prepayment of $54,000 in rent on his home, prepayment of utilities and phone bills, and reimbursement for expenses such as camera rentals after he received a termination letter on Nov. 15, 2001.
Showing Schaffel one of the checks, Mundell said, "And you dated it Nov. 14 because you knew if you dated it after that you would run into problems because of the termination?"
"Yes," said Schaffel.
Schaffel also said he "just didn't want to get caught holding the bag for expenses Mr. Jackson had agreed to."
He said there was an agreement for Jackson to pay his expenses for six months after the date of termination.

Questions about 'French Fries'King: Well let me ask this, this might key your memory. Did he deliver the money in an Arby's bag?
Jackson: Could have been true, yeah.
King: Yeah. The money smelled like French Fries?
Jackson: They didn't smell like French Fries, no. (Laughs)
King: But uh, after that event when you called Marc for money, would you instead of asking him for money, would you ask him for French Fries?
Jackson: I think that was the term that was used. But, I don't remember it being over a hundred thousand. I don't.
King: We'll get to that. But, so after the time he delivered money to you in an Arby's bag, and there were subsequent occasions when you called him and asked for French Fries, correct? Instead of asking for money.
Jackson: I don't know if he made up that expression, or I did. I don't know. I really don't know. But, I do remember it.
King: Right. I don't care who made it up, I just wanna confirm that after the first time he brought you cash in an Arby's bag, you would ask him to bring you cash but you would ask for French Fries instead of cash.
Jackson: I don't know that.
King: Well, you just said that you remember that, but you don't remember asking?
Jackson: I remember it one time he brought in an Arby's -- but it wasn't like a habitual thing.
King: Okay. Umm, do you remember it ever happening after that one time where you called him and asked him for French Fries instead of asking him for cash?
Jackson: Could have been. It could have been.
King: And do you remember sometimes asking him to super-size those fries?
Jackson: I don't remember that (laughs)

Introduction and Subpoena GrandstandingKing: Good morning, Mr. Jackson.
Jackson: Good morning. (Clears throat)
King: We've met before in London so I won't go through the rules for deposition because I know you've heard those before. I would ask you-- I remind you we are following up on your deposition of September 23rd of 2005. Umm, before trialing this action. You remember you were deposed on September 23rd, 2005 by me?
Jackson: Yes.
King: Okay, have you had the opportunity to review the transcript of your testimony from that deposition?
Jackson: No.
[Several minutes later]
King: The first thing I'm going to do, Mr. Jackson, is I'll have the record reflect that I'm going to hand you a subpoena, requiring your attendance at trial, uh, next month in Los Angeles. (Michael laughs)
Mundell: Okay, just for the record, Michael so you know, that subpoena is ineffective.
Jackson: Okay, I know. (Smiling)
Mundell: That doesn't mean a thing. That's just grandstanding, trying to intimidate you and throw you off. That's the sort of thing he does. We can take this and just rip it up, tear it up. That's nothing (Mundell rips up subpoena)
King: Uh, let the record reflect that Mr. Mundell has torn up the trial subpoena...

Michael Jackson Deposition Transcript
Marc's Gay Pornography ProductionsKing: At some point in time you started entertaining projects for Marc Schaffel. Right?
Jackson: Yes.
King: And at some point in time you actually started doing projects with Mr. Schaffel?
Jackson: Yes.
King: My question is, before you started doing projects with Mr. Schaffel, did you have anyone do any inquiry into whether-or-not Mr. Schaffle had the background to be a trusted person to do projects with?
Jackson: I wish I could have. I wish I had done that. But I didn't.
King: You didn't do it.
Jackson: And when I did do it, I wasn't happy.
King: Well, when did you do it?
Jackson: I didn't do it myself. Someone else came to me with a history of his past and everything.
King: And who came to you with that [information]?
Jackson: A lawyer.
King: Well you know it was another question. I said what did you learn about Marc Schaffel's background that made you unhappy?
Jackson: Umm, one of my lawyers came to me and--
King: But don't tell me what your lawyer said. Whatever you learned from any other source.
Jackson: Okay, I'll just rephrase it. The whole, gay porn industry business he was in. And, at that moment, I said I want to be diplomatic about it and-- so he shouldn't be associated with us anymore. Umm, you know, it just wouldn't be good.
King: So, you learned at some point-in-time about Mr. Schaffel's background in what you call gay pornography.
Jackson: That's not what I called it. That's what it was.
King: It was gay pornography?
Jackson: Yes.
King: How do you know that?
Jackson: Because--
Mundell: I'm going to ask him [Michael] not to [repeat anything] from the lawyer again.
Jackson: Okay, okay. Well, I can't say it then.
King: Well, other than your lawyer, did you ever see any of this supposed gay pornography?
Jackson: The lawyer? Uh--
King: No, I'm not asking you to talk to your lawyer. Did you ever see any?
Mundell: If he showed him some, that would not be--
King: That would not be privileged.
Mundell: So, if you were shown anything by the lawyer, you can tell it.
Jackson: I was. I was referring to that. I was shown a videotape by the lawyer and I was shocked what I saw. Because, I didn't want to believe it when he told me. Then he said, 'well you have to see this.'
Mundell: But Michael, please don't say anything the lawyer said. Just what he showed you.
Jackson: Okay.
King: You were shocked. What is it that you saw that shocked you?
