Dr. Conrad Murray's Attorney Reacts to Wrongful Death Suit Filed by Joe Jackson

The attorney to the late Michael Jackson's former personal physician Dr. Conrad Murray released a statement to ET in reaction to the wrongful death lawsuit filed by the King of Pop's father Joe Jackson.

Dr. Murray's attorney tells ET of the suit: "We continue to maintain Dr. Murray neither prescribed or administered anything that should have killed Michael Jackson. Dr. Murray is beloved by his patients because he is a compassionate, responsible physician dedicated to his patients' health. We'd like to remind people that Dr. Murray has not been found guilty of anything and we believe his innocence will be proven in a court of law. We've been told we were going to be sued for months so today's filing is no surprise to us."

The Jackson family patriarch seeks a minimum of $75,000 in the lawsuit and accuses Murray of professional negligence, providing Michael substandard medical care, and withholding information about Propofol, the drug that authorities believe killed the King of Pop. Acres Home Heart & Vascular Associates Inc. and GCA Holdings LLC are also named as defendants in the suit.

Dr. Murray has pleaded not guilty to an involuntary manslaughter charge in Michael's death.

Michael Jackson feared he had heart condition, cancer

'King of Pop' Michael Jackson became paranoid in the six months before he died and believed he suffered heart attacks and had cancer, a media report said. According to his aides, Jackson's delusions were caused by his mind and body being ravaged by his addiction to prescription drugs and
painkillers, the News of the World reported.

"He was a mental wreck and always felt he had a disease. He was terrified of the sun as it irritated his vitiligo (skin condition) prompting him to claim he had cancer and brain tumours," an aide was quoted by the British tabloid as saying.

"At other times he said he was freezing cold and might have frostbite. On reflection his body and mind were just wrecked by drug use," the aide added.

Jackson also complained of suffering heart attacks leading up to his death in June last year. That's why he hired cardiologist Conrad Murray who is charged with "involuntary manslaughter" as the case nears trial.

His family friend and prosecution witness Terry Harvey was quoted as saying, "I discovered Murray knew about Michael's drug problems for a long time. Michael was a drug-addicted wreck and complained for months about being too ill to perform his shows".

Terry added: "I expect at Murray's trial all those secret things I have discovered will come to the fore".

Another source claimed: "If you are hired as a round-the-clock medic your job is to know what your patient is taking".

  • Expert Anesthesiologist Thinks Michael Jackson’s Physician,
Dr. Conrad Murray Will Go to Jail

With strong emotions both for and against Michael Jackson’s Physician, Dr. Conrad Murray, it is interesting to see what a colleague in his field thinks about his responsibility in the stars untimely death. In the hours before his death, Michael Jackson was treated to a buffet of tranquilizers, prescription drugs and a drug that is rarely administered outside the parameters of hospital and clinic-based medical procedures — propofol. It’s the use of that final drug, and the rumors of Jackson ’s love for the sleep inducer, which he called his “milk,” that makes Dr. Barry Friedberg, a veteran anesthesiologist and author of the book Getting Over Going Under (Dr. Barry Friedberg | Anesthesia Expert), believe that the pop star’s death was imminently preventable and unnecessary.

“To say that Michael Jackson’s death was preventable is to say that the best way to avoid injury is not to jump off a cliff,” said Dr. Friedberg. “While there may be little difference in the logistics of administering propofol in a hospital and administering it in a private setting — as was the case with Jackson — it is not intended to be used as an intravenous sleeping pill. Propofol is a serious drug that is amazingly effective and gentle when used appropriately in surgical procedures. Dr. Murray was essentially enabling Jackson to use it like it was an over-the-counter pain reliever.”

Dr. Friedberg, who also runs a not-for-profit advocacy group that extols the virtues of brain monitors as a standard of care device for anesthesiologists, is closely watching Dr. Murray’s case. He believes that Dr. Murray, whose preliminary hearing on charges of involuntary manslaughter is set for August 23, will definitely be spending some time in prison for his role in Jackson’s death.

“The only way he walks away from this is in an orange jumpsuit and irons,” said Dr. Friedberg. “Although he may not have intended to kill Jackson, Murray clearly caused Jackson’s death involuntarily. What would have prevented Jackson’s death? A knowledgeable physician who, at the very least, both watched Jackson and monitored his oxygen would have not put his patient in mortal danger. If he wanted to be more responsible, he could have used a brain monitor to measure the propofol effect, and as a result, he would have prevented administering the dose that stopped Jackson’s breathing.”

According to court documents, Dr. Friedberg said some elements of the case are indisputable:

•Propofol is the last of a series of drugs Dr. Murray admitted to giving Jackson.
•Murray admitted being out of the room shortly after giving Jackson the propofol.
•Propofol is the drug the Los Angeles coroner declared was the cause of Jackson’s death.

“Let me emphatically state that since its 1989 introduction to the North American market, tens (if not hundreds) of millions of patients have safely received propofol,” he said. “It was safe because someone was watching and monitoring these patients, which represent two features apparently absent in Michael Jackson’s bedroom the day he died. Until recently, propofol has only been given by dedicated, trained anesthesia providers like anesthesiologists, nurse anesthetists or even anesthesia assistants under supervision. When given for surgery, propofol is always monitored with electrocardiogram (EKG), blood pressure and pulse oximeter (SpO2). Neither of these devices was apparently in use when Dr. Murray administered the fatal dose. At this point, I don’t think it’s a matter if Dr. Murray is convicted. It’s a matter of when, and how long he will spend behind bars for his irresponsible and unconscionable conduct that is a disgrace to the vast majority of practicing physicians who remain true to their oaths to do no harm.”

    About Dr. Barry Friedberg

A native of southeastern Pennsylvania, Barry L. Friedberg, MD (Dr. Barry Friedberg | Anesthesia Expert), came to Palo Alto, California in 1975 to complete his formal education with an anesthesia residency at Stanford University. Following the successful completion of his residency and the requirements of the American Board of Anesthesiology, Dr. Friedberg became a Board Certified (or Diplomate) Anesthesiologist in April 1980. He has also lectured on safer, simpler, cost-effective and better patient outcomes to anesthesiologists and surgeons in the United States, Canada, Mexico, the Dominican Republic, Israel and Venezuela.

    !!!!!!!!!!!!!!!! JUSTICE FOR MICHAEL !!!!!!!!!!!!!!!!!!

  • Doctor charged in Michael Jackson's death returns to court
    By Alan Duke, CNN
    August 23, 2010 -- Updated 1028 GMT

Los Angeles, California (CNN) -- When Dr. Conrad Murray returns to a Los Angeles court Monday afternoon, he is likely to be hounded by dozens of Michael Jackson fans angry about the pop star's death.

Monday's hearing is expected to be quick. It will set a date for the preliminary hearing in the involuntary manslaughter case against Murray, his lawyer said.

The judge has indicated the preliminary hearing will be in October and is expected to last more than a week.

The Los Angeles County coroner ruled that Jackson's death on June 25, 2009, was from an overdose of propofol, a powerful anesthesia used to put surgical patients to sleep.

Murray, hired as Jackson's personal doctor while the singer rehearsed for his comeback concerts, admits giving him propofol as a sleep aid. But Murray's lawyer said the amount was much smaller than what was found in Jackson's body during the autopsy.

"The fact [of the way] that he died was a mystery a year ago, and still is," Houston attorney Ed Chernoff told CNN in an exclusive interview recently.

Members of Jackson's family have attended each hearing since Murray's arrest in February.

When brother Jermaine Jackson left the last hearing in June, he indicated some of them were not satisfied with the case against Murray.

"Dr. Murray's the fall guy," Jermaine Jackson said after the hearing. "This is bulls**t."

California authorities announced last month that seven other doctors and a nurse who treated Jackson will not face criminal prosecution in connection with the singer's death.

Judge Michael Pastor denied a request by the state medical board to order Murray to stop practicing medicine as a condition of his bond while he awaits trial. His lawyer said he has no California patients, although he continues to treat patients in Nevada and Texas.

Jackson fans have organized protests at each hearing, taunting Dr. Murray as he entered and departed the courthouse.

One fan website said they would follow Murray "into the streets" after Monday's hearing with banners on an overpass of the Hollywood Freeway.

  • Dr. Murray Wants Michael Jackson Fluid Samples

Sources tell TMZ ... Dr. Conrad Murray's lawyers will ask the trial judge today for an order allowing them to get fluid samples from Michael Jackson -- to help with their defense in the involuntary manslaughter case.

We're told Dr. Murray's lawyers want to re-test some of the fluids to determine the accuracy level of the Propofol found in Michael Jackson's body.

According to the L.A. County Coroner's report Jackson died of acute Propofol intoxication.

We've learned the Coroner has fluid samples and we're told they've been preserved.

Also today in court ... Judge Michael Pastor is expected to set a preliminary hearing date. The spokesperson for Dr. Murray's lawyer, Ed Chernoff, has said whatever date the judge wants is fine with them ... "If he wants it next week, we'll be there next week."
